Description

1) The subject of the contract is delivery in the period from 1 January 2025 to 31 December 2025 to the seat of the Ordering Party, in the assortment and estimated quantities given in the tables (Annex I). No. 1). The Ordering Party informs that the order has been divided into seven lots. Contractors shall be entitled to submit a tender for any number of lots. 2) The frequency of delivery of goods will be carried out successively and in quantities depending on the needs of the Ordering Party. 3) The estimated quantities of goods delivered within 12 months given in the tables are the basis for calculating the offer price, which may change depending on current needs. The Ordering Party guarantees the execution of the order in quantities of min ± 20% , i.e. from 80% to 120% of the estimated quantity of goods. For these contract sizes, the gross price given, calculated per 1 unit of measurement of a given assortment, will be valid for the entire duration of the contract, except in the cases indicated in the draft contract or resulting from the circumstances indicated in the Acts. For the purpose of determining the price of tenders, the estimated quantities indicated in the individual annexes to a given lot shall apply. 4) The delivery of goods will take place by the Contractor's own transport and at his expense to the seat of the Ordering Party (food warehouses in SP ZOZ Sanatorium Uzdrowiskowe MSWiA " AGAT " ul. Cervi 14 Jelenia Góra), on dates, assortment, required packaging and in quantities in accordance with the current demand of the Ordering Party. 5) The Ordering Party shall notify the authorized contact person indicated in the offer by phone about each delivery and indicate the ordered products with the quantity by 14:00 on the day preceding the day of delivery. The order will be sent from the e-mail address: zywienie@sanatorium-agat.pl. 6) Compulsory execution of the order on the next day after placing the order from 07:30 to 10:30 (unless a different delivery date is indicated in the order). 7) Delivery of ordered goods to the customer's premises with a guarantee of delivery from Monday to Saturday (if necessary). 8) In the case of a complaint about the quality and quantity of the delivered goods, the contractor is obliged to deliver a new batch to the Employer's headquarters within 2 hours on the day of submitting the complaint in accordance with the declaration submitted in the content of the offer (an element of the tender evaluation criteria - the possibility of shortening this period). 9) In the event of failure to deliver the part of the assortment ordered for a given day and hour (not meeting the requirements indicated in the SWZ and the contract), the Ordering Party reserves the right to immediately purchase the goods from another supplier, but if the purchase price is higher than proposed in the submitted offer of the Contractor, on the basis of which it was selected to perform the order - the Ordering Party will charge the Contractor with the difference in the purchase price by deducting the calculated amount of the difference in the purchase price from the nearest invoice of the Contractor. Such a deduction need not be authorised by the Contractor. 10) Supplied food products must meet the requirements contained in the SWZ and the contract, including: a) meet the quality requirements described in individual Tables, b) meet the required type and size of packaging, c) be labelled in accordance with the requirements of the Regulation of the Minister of Agriculture and Rural Development of 23 December 2014 on the labelling of foodstuffs (Journal of Laws of 2014, No. U. of 2015, item 29), including in particular, each package must bear a label containing, inter alia: • have the name and address of the manufacturer or importer with information on the country of origin, • have the name and type of product, class/species, for articles for which it is particularly required by the entry in the Tables, • have a shelf-life (dd/mm/year), • have a net weight, • have a list of ingredients according to the share of raw materials, • be delivered during their initial warranty period, • be ensured proper transport and storage of the assortment, in accordance with sanitary and epidemiological requirements, especially in terms of ensuring the cooling of food products, in a way that maintains their proper commercial quality (in particular: nutritional, taste, organoleptic). 11) The Contractor is obliged to maintain the continuity of supplies in a crisis situation and in the event of militarization of the unit in the country or in the region. 12) The contracting authority allows partial tenders to be submitted for one or more of the lots listed in these specifications (lots 1 to 7). 13) Warranty requirements. The shelf life of the producer's (supplier's) food products applies. The quality guarantee period is not a criterion for the evaluation of tenders. 14) Information on the possibility of the Contractor entrusting the performance of part of the contract to subcontractors: The Contracting Authority shall not introduce a reservation indicating the obligation of the Contractor to personally perform key parts of the contract. The contractor may subcontract part of the contract. 15) Requirements for the contractor: a) The Contractor is responsible for the quality, compliance with the technical and quality conditions described for the subject of the contract. b) Due diligence is required in the performance of the contract. c) Arrangements and decisions regarding the performance of the contract will be agreed by the Contracting Authority with the Contractor's appointed representative. d) The determination by the Contractor of contact telephone numbers and fax numbers, and other arrangements necessary for the efficient and timely performance of the contract. e) The Contracting Authority shall not be liable for damage caused by the Contractor during the performance of the subject of the contract. f) Place of performance of the contract; indicated food warehouse in the building SP ZOZ Sanatorium Uzdrowiskowe MSWiA "Agat" in Jelenia Góra at ul.
