The subject matter of the contract is forest management services as defined in Article 6. 1 pt. 1 of the Forests Act of 28 September 1991 (consolidated text: OJ Journal of Laws 2014, item (1153 as amended) including work on forest breeding and conservation, fire protection, timber harvesting and harvesting, tourist forest management and secondary forest use to be carried out in the area of the Daleszyce Forest District in 2016. A detailed description of the subject-matter of the contract, including a detailed description of the technology for carrying out the specific works (activities) forming part of the subject-matter of the contract, is set out in Annexes 2.I, 2.II, 2.III, 2.IV and 2.V to the ToR. The place of performance of the subject of the contract will be the administrative area of the Daleszyce Forest District, with individual lots being executed within the administrative boundaries of forestry – which are specific to the lot in question. The descriptions of the activities forming the subject-matter of the contract and their codes are contained in Annexes 2.I to 2.V to the ToR. Lots: The subject matter of the contract is divided into 5 lots: Part I – Forestry Management in the Field (Italy Forestry, Sieraków, Cisów); Part II – Forestry management in the Obrębie marzy (the Forestry of Niestachów, Marish and Radomice); Part III – Forestry Management in the Szczecno Forestry (Trzemosna and Łuczewnica Forestry); Part IV – Specialised package entitled Wood harvesting with multi-operated machinery and breaking, mechanical soil preparation, mechanical grinding of post-harvest residues and protection of forest crops against game by fencing them; Part V – Specialised package – Fire protection. The contractor may submit a tender for one or more lots. The tender submitted for a given lot must cover the entire range of works provided for in the ToR for the lot in question. General rules for performance of the subject matter of the contract. (1) The Contractor will perform the subject matter of the contract on the basis of written orders sent by the representatives of the Contracting Authority (hereinafter: ‘Order’). The contract will specify the scope of the work to be carried out, the date on which it will be carried out, the location (forest address) and, if necessary, the specific requirements as to how the work will be carried out and the parts of the work which are the subject of the sub-receipulations. (2) The Contractor will be required to clean up all waste and waste from the surface on which the work is carried out and waste remaining after collection in the immediate vicinity, particularly from adjacent roads and drainage ditches. (3) The Contractor will be required to use biodegradable oil for hydraulic equipment and to spread chainsaws and oil absorption kits in facilities operated on the forest site. (4) For the spreading of chain saws in the equipment in operation, the Contractor will be required to use biodegradable oil with a biodegradability parameter of not less than 60 %. A determination of biodegradability is required in accordance with the test methodology described in Commission Regulation (EC) No 440/2008 of 30 May 2008 (OECD screening test A-C) laying down test methods pursuant to Regulation (EC) No 1907/2006 of the European Parliament and of the Council on the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH). 5) The estimated quantity by volume or weight of biodegradable oil consumed for spreading chain saws will be the expected weight of harvesting in m³ resulting from the harvesting plan, taking into account the following standards: using a sawing machine is 0.05 litres per m³ of harvested wood, – 0.02 litres per m³ of harvested wood. 6) Any request from the Contracting Contractor, the Contractor will be required to submit purchase invoices for the oil together with a ‘Charter of Dangerous Preparation Characteristics’ showing the degree of biodegradability of the oil purchased, corresponding to the volume of m³ of wood harvested. The contracting authority will have the right to verify the oils used to lubricate the cutting systems and the Contractor shall allow the Contracting Authority to take samples of oil in the quantity necessary for testing its parameters. The cost of laboratory tests will be covered by: Contracting authority, if the biodegradability parameter is not less than 60 % according to the test methodology as indicated above, the Contractor if the parameter is lower than 60 % according to the test methodology as indicated above. 7) When carrying out the work, the Contractor will be required to have suitable oil-absorption kits on mechanical equipment (harvester, forwarder, tractor, trailer with a crane and other equipment, and sawing machines at the place of refuelling), the use of which may cause oil contamination of the environment during the work in the forest and during access and return from the working surface. It is permissible for sanders to possess and use canisters with safe tips (carriers) preventing spillage of oil and fuel mix (filling) during the refuelling of the sawing machine (replacing for oil- and fuel-absorbing mats). 8) The Contractor is required, during the execution of the contract, to mark the entry ban in accordance with Article 26 of the Forests Act. In particular, the Contractor shall be required to carry out appropriate markings of the surfaces on which the harvesting, breaking and grinding of wood residues and other work provided for in the instructions referred to in point.3.2 will be carried out. The location of the tables prior to the start of the works needs to be agreed with the competent forestry community. The contractor may subcontract part of the subject matter of the contract to subcontractors. To the extent that the Contractor in the Tender has undertaken to perform the subject-matter of the contract with the assistance of persons employed under an employment contract, the Contractor shall ensure that the persons performing the contract will be employed on the basis of an employment contract within the meaning of the Labour Code. The obligation to perform the subject-matter of the contract with the assistance of persons employed on the basis of an employment contract also applies to the performance of the contract with the assistance of subcontractors. Optionally, the Contracting Authority is entitled to entrust the Contractor with additional material scope covering activities similar to those described in the description of the subject-matter of the contract (hereinafter: “Option”). The contracting authority shall not be obliged to commission the work covered by the Option and the Contractor shall not have any right to commission them. The work covered by the Option may be subcontracted for a value of up to 20 % of the value of the subject-matter of the contract determined in accordance with Section 9(1). 1 of the model contract annexed to Annex 10 and determined in accordance with Paragraph 19(1). 1 of the model contract set out in Annex 11 to the ToR.
