1. The subject of this contract is the supply of medical devices for the Maria Skłodowska-Curie National Oncology Institute - National Research Institute of the Gliwice Branch 2. The subject of the contract is divided into 2 separate tasks. 3. The description of the subject of the contract and the conditions for the performance of the contract are contained in the annexes: 1) Technical parameters, product and price specifications – Annex No 2.1-2.2 to the FTZ, 2) Draft provisions of the contract to be introduced into the content of the contract – Annex No 4 to the FTZ. 4. The Contractor must attach to the tender the following means of proof confirming that the subject of the contract offered meets the requirements specified by the Contracting Authority: Declaration of conformity and/or CE certificate (depending on the class of medical device) and relevant statements (if required) in accordance with Regulation 2017/745 on medical devices (MDR) or Council Directive 93/42/EEC (MDD) with subsequent transitional provisions. The above documents referred to in point. 2 above are the means of evidence in question, which are to confirm that the offered subject of the contract meets the requirements specified by the Ordering Party. Having regard to Article 107 para. 2 of the Act, the Contracting Authority informs that the evidence referred to in point. 2 shall be supplemented if they are not submitted with the tender or are incomplete. 5. The contracting authority allows the possibility of submitting tenders for selected tasks. Tenders not containing the full scope of the subject of the contract in a given task will be rejected. 7. The contracting authority allows for the possibility of submitting equivalent tenders - the description of equivalence is contained in Chapter IV of the FTZ. 6. The contracting authority does not require the lodging of a security in the present proceedings. 7. The Contracting Authority shall require the Contractor to lodge a security for the proper performance of the contract in respect of task No 1. 8. The contracting authority does not provide for electronic auctions or supplementary contracts. 11.The information clause resulting from Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, was included by the Ordering Party in the FTZ. 9. Information on the contractors’ joint procurement is included in Chapter IX of the FTZ. 10.The Ordering Party provides for the possibility of changes to the provisions of the concluded contract (the so-called contractual changes based on Art. 1 point 1 of the Public Procurement Act) in relation to the content of the tender on the basis of which the Contractor was selected, in accordance with the conditions set out in Annex 4 to the FTZ. Any agreement may also be amended in the cases referred to in Article 455(1)(2)-(4) and Article 455(1)(2)-(4). 2 of the PPL Act. 11. The Contracting Authority does not envisage convening a meeting of the Contractors to explain the FTZ and does not envisage carrying out a local inspection. 12.
