Poland-Świętoszów: Hand tools
The subject-matter of the contract is the delivery, together with transport, unloading and transfer to the premises indicated by the Contracting Authority, of tools, equipment and workshop equipment in the range and quantities indicated in detail in the price form corresponding to the description of the subject-matter of the contract and the Polish standards transposing harmonised European standards.
The place of delivery will be the warehouses of the Military Unit 5350 respectively. The arrangements and decisions relating to the performance of the contract shall be agreed between the Contracting Authority and the appointed Contractor’s representative.
The Contractor must indicate in the price form the trade name – the producer and the indication (name, number, symbol, type, etc.) of the goods offered.
The goods offered must meet all the parameters set out in the tender specifications and the price form, be new and free of defects and have intact the characteristics of the original packaging.
Specific requirements for the subject-matter of the contract:
1. The goods delivered to the Contracting Authority must be new (Category I) and released for free circulation in accordance with DIN, ISO, PN standards.
2. The procurer requires tools, power tools, and purely professional workshop equipment. The technical parameters set out in the price forms have been provided to the Contractors in order to define precisely the range requested and should be regarded as minimum requirements defining the subject-matter of the contract.
3. The guaranteed working period of the tools supplied shall ensure that they are properly usable for a period of at least 12 months.
4. Installation and transport costs relating to the delivery of the goods shall be borne by the Contractor.
5. The goods supplied will be subject to a quantitative and qualitative acceptance at the Contracting Authority’s premises of the technical characteristics in the presence of a representative of the Contractor (in the case of delivery of the subject-matter of the contract by courier companies).
6. The equipment offered is intended to be available on the market, it is not permitted to create equipment under a specific contract. Prototype products are not permitted.
7. The Contractor is required to provide with delivery any guarantees from the material manufacturer, safety certificates, technical approvals, declarations or certificates of conformity.
The Contractor shall be responsible for the quality and compliance with the technical and quality conditions laid down for the subject-matter of the contract. Due diligence is required in the performance of the contractual obligations.
If an equivalent range is offered, i.e. different from that proposed by the Contracting Authority, the Contractor must submit with the tender a document in Polish, e.g. a detailed specification, folder or catalogue from which, in a manner which gives rise to no doubt by the Contracting Authority, it should be indicated that the product range used has the same or better parameters with regard to the range specified by the Contracting Authority in the description of the subject-matter of the contract.
The place of delivery will be the hall of the military unit 5 350 in Świętoszów:
— for JW 5350- ul. 1 Saintsh’s bar,
— for JW 2399- ul. 1 Saintsh’s bar,
— for JW 2423- ul. Żagań Żagań Żagań,
— for JW 2649- ul. Zarska 1 Zagań
or the place indicated in advance by the Contracting Authority. The arrangements and decisions relating to the performance of the contract shall be agreed between the Contracting Authority and the appointed Contractor’s representative.
The contractor will attach to each copy of the equipment supplied a guarantee card and instructions in Polish – installation, use and operation. A guarantee in accordance with the manufacturer’s guarantee.
For equipment supplied under the contract, the Contractor will provide a guarantee for a minimum period of 12 months (unless otherwise specified in the description of the subject-matter of the order in the price forms), starting from the date of signature of the acceptance report by the Contracting Authority’s representatives and the representatives of the Contractor.
If physical defects in the supplies delivered are found during the warranty period, the Contracting Authority shall notify the Contractor in the form of a ‘Complaints Report’ within 14 days of the date on which the defect was discovered. In this case, the Contractor shall:
Examine the ‘Complaints Report’ within 7 days of its receipt;
Remedy the defect within 14 days of the date on which the ‘complaints report’ was examined;
3. if it is not possible to remedy the defects in the product range, the Contractor shall replace it with a new one, free of defects, within 30 days of the date of examination of the ‘Complaints Report’.
The guarantee shall be extended for a period during which, as a result of defects, the Contracting Authority was unable to use it. The defective replacement range shall be transported at the Contractor’s expense and responsibility. The Contractor will carry out the replacement without any surcharge, even if prices change.
The guarantee shall not apply where the failure is due to: improper use, caused by an external cause, of improper handling during use, due to damage caused by the use of a product for which the Contractor is not responsible.
The Contractor shall be responsible for the quality and compliance with the technical and quality conditions laid down for the subject-matter of the contract. Due diligence is required in the performance of the contractual obligations.
The Contractor will be required to issue separate invoices for each Unit and for each Unit.
