In order to respect legal prerogatives such as Law No. 46-942 of 7 May 1946 establishing the order of expert surveyors, but also developments in case law on co-ownership, four framework agreements will be put in place. The award of lots 1a and 2a is reserved for the specific profession of expert surveyors under the following regulations: Law No. 46-942 of 7 May 1946 establishing the Order of Expert Surveyors. The framework agreement is part of an agreement constituting a grouping of orders concluded between LOGIAL-COOP and KREMLIN-BICETRE HABITAT signed on 15 July 2024. LOGIAL-COOP shall be designated coordinator of the group and shall be responsible for all operations relating to the award of this framework agreement until it is notified. LOGIAL-COOP will therefore be the sole interlocutor of the candidates. Each member of the group will then monitor, execute and pay the purchase orders drawn up on the basis of this framework agreement for the lots concerning him. Lots under the framework agreement shall be executed only by issuing order forms. Order forms shall be executed as and when the need arises, in accordance with the provisions of Articles R.2162-1 to R.2162-6, R.2162-13 and R.2162-14 of the Public Order Code. The services will be performed by applying the BPU prices to the quantities actually executed/ordered. The lots of the framework agreement shall be concluded in accordance with Article R2162-4-2° with only a maximum as follows: - Lot 1a: EUR 125 000 excl. tax/year and EUR 500 000 excl. tax over the total duration of the framework agreement, including any renewals. - Lot 1b: 188 000 euro(s) excluding VAT/year and 752 000 euro(s) excluding VAT over the total duration of the framework agreement, including any renewals. - Lot 2a: EUR 63 000 (s) excluding VAT/year and EUR 252 000 (s) excluding VAT over the total duration of the framework agreement, including any renewals. - Lot 2b: 94 000 euro(s) excluding VAT/year and 376 000 euro(s) excluding VAT over the total duration of the framework agreement, including any renewals. The maximum annual order amount for each lot remains the same in the event of renewal. However, the contracting authority reserves the right, if the maximum amount of the lot concerned is reached before the end of the current period, to make advance expenditure for emergency purposes up to a maximum of 25% of the maximum amount of the lot concerned. The renewal of the lot concerned will then cover 75% of the maximum remaining amount. In the event of a decision not to renew a lot, the contractor concerned will be remunerated for all expenditure actually incurred. The estimated value of the requirement of EUR 1 500 000 excluding VAT is estimated over the total duration of the framework agreement (for the four lots), including any renewals.
