Description

The contracting authority will conclude a framework agreement for 4 months, with a maximum of 5 op ec, and the subsequent contracts will be concluded and carried out by the beneficiary authority - Gherla Penitentiary. Subsequent contracts shall be concluded under the following conditions: a) On the date of entry into force of the agreement, for a period of 2 months, the price is firm, the subsequent contracts will be concluded without reopening the competition, with the promising supplier ranked first; if the first promising supplier does not support its price or refuses to conclude the subsequent contract, it is obliged to prove the impossibility of fulfilling the contractual clauses, the contracting authority having the possibility to conclude the contract with the next ranked, until the ranking is exhausted. b) The award of subsequent contracts, after the first 2 months from the conclusion of the framework agreement, until its completion, will be made by reopening the competition, if necessary, organized at the level of the beneficiary contracting authority, the subject of which is the score given by the Price. The quality factor scores shall be maintained throughout the duration of the framework agreement, changing only the price score following the tender submitted with the re-tendering requests. Adjusting the price in the first 2 months is not allowed. After the first 2 months the price can be adjusted under the conditions stipulated in the framework agreement. In the cases provided for in Art. 118 par. (1) letter b), the beneficiary authority shall resume the competition on the basis of the same terms and conditions applied for the award of the framework agreement, detailed where necessary and supplemented, if necessary, with other terms and conditions provided in the award documentation drawn up within the award procedure and in compliance with the following procedural rules: a) for each substation to be awarded, the beneficiary contracting authority shall consult in writing op ec signatories of the respective framework agreement who are capable of performing the contract;b) the beneficiary authority shall set a sufficient period for the submission of tenders for the award of the contract, taking into account specific elements such as the complexity of the subject matter of the contract and the time required for the submission of tenders;c) tenders shall be submitted in writing and they will not be opened until the expiry of the period set by the beneficiary contracting authority. d) Economic operators shall have the right, in the re-tendering process, to modify the element subject to the re-opening of competition (PRETUL) only in order to improve it and without affecting the other elements/conditions set. e) If, following the re-tendering, the economic operator ranked first in the framework agreement no longer maintains or improves the tendered price, the beneficiary contracting authority shall conclude ctrs with the economic operator ranked next in the following position shall maintain or improve the price tendered under the framework agreement. f) in the event that no improvement is obtained in the elements/conditions subject to the reopening of the competition, the provisions of Article 110(7) of the Annex to Government Decision No 395/2016 become applicable, the contracting authority having the obligation to award the first-ranked tenderer in the applied procedure, by taking into account the conditions and elements set out in its updated initial offer.
