The subject of the contract is the provision of SAP Enterprise Support maintenance services for the integrated SAP IT system used by the General Directorate for National Roads and Motorways, in accordance with the conditions for the provision of SAP Enterprise Support services on the current terms specified by SAP AG. In view of the specific nature of the subject-matter of the contract, pursuant to Article 106(1) of the Public Procurement Act, the Contracting Authority requires the Contractor applying for the award of the contract to have: 1) a valid SAP Partner Center of Expertise (PCoE) certificate entitling to provide maintenance services for SAP software or 2) a certificate issued by SAP Polska Sp. z o.o. or SAP A.G. confirming that the Contractor has the right to provide maintenance services for Enterprise Support for SAP Software, i.e. has a partnership agreement with SAP A.G. or 3) service rights granted by SAP A.G. or SAP Polska sp. z.o.o.
