1. The subject of the contract is: Part 1 - Supply of a medium rescue and fire-fighting vehicle for the Voluntary Fire Service in Łosice, together with the supply of equipment for a medium rescue and fire-fighting vehicle for the Voluntary Fire Service in Łosice, together with the adaptation of the lockers to the specified items of equipment. The detailed description and requirements of medium rescue and firefighting vehicles, their equipment and the conditions to be met by the subject of the contract are set out in the description of the subject of the contract constituting Annex 1 to the FTZ. 3. There was no division of the contract into more lots for the following reasons. The characteristics of the contract, in particular its subject-matter, do not allow the contract to be divided into lots for technical and economic reasons. Execution of the contract by the Contractor will make it possible to enforce the warranty and guarantee rights more effectively. In order to ensure the compatibility of the equipment with the cars, the unbundling of the supply would risk insurmountable organisational problems related to the responsibility for the individual elements of the supply made by the different Contractors and the installation of the car including the equipment. The contract constitutes a coherent whole, which results directly from the description of the subject of the contract. The subject of the contract is the supply of two new medium-sized rescue and firefighting vehicles with equipment. There would be a risk of conflict between equipment fitters and car suppliers in the event of warranty claims. The need to coordinate the actions of the different contractors performing the different lots could seriously jeopardise the proper and timely performance of the contract. The scope and specificity of the contract justify the award of the contract to the Contractor, who will assume responsibility and risk for the entire contract. Dividing the contract into lots would hinder efficient spending and timely performance of the contract. 4. Where, and wherever, reference is made in the description of the subject-matter of the contract to the standards, technical assessments, technical specifications and technical reference systems referred to in Art. 1 point 2 and paragraph. 3 of the Public Procurement Act, the contracting authority allows there solutions equivalent to those described, and such reference is accompanied by words or equivalent. The contracting authority shall allow solutions equivalent to those described in the description of the subject-matter of the contract in this procedure, by means of standards, European technical assessments, approvals, technical specifications and technical reference systems referred to in Art. 4 of the Public Procurement Act, the Employer indicates that it should be assumed that this reference is accompanied by words or equivalent. Where the description of the subject-matter of the contract refers to standards, technical assessments, technical specifications and technical reference systems referred to in paragraph 1. 1 point 2 and paragraph. 3, the contracting authority may not reject the tender on the sole ground that the works, supplies or services offered do not comply with the standards, technical assessments, technical specifications and technical reference systems to which the description of the subject-matter of the contract refers, provided that the economic operator proves in the tender, in particular by the means of evidence referred to in Articles 104 to 107, that the solutions proposed satisfy in an equivalent manner the requirements set out in the description of the subject-matter of the contract. 5. The Contracting Authority does not reserve the possibility of applying for a contract only by the Contractors referred to in Article 94 of the Public Procurement Act. 6. The Contracting Authority shall not require the Contractor or subcontractor to be employed on the basis of the employment relationship of persons performing activities related to the performance of the contract. 7. The Contracting Authority does not require the Contractor to employ the persons referred to in Art. 2 point 2 of the PPL Act. 8. The Contracting Authority does not provide for an obligation for the Contractor to carry out an on-site inspection and for the Contractor to check the documents necessary for the performance of the contract available on the spot from the Contracting Authority. 9. The Ordering Party does not allow the possibility of adding electronic catalogues to the offer. 10. The Ordering Party does not provide for settlement in foreign currencies. -The procedure is conducted in an open tender procedure pursuant to Article 132 of the Public Procurement Law Act of 11 September 2019, hereinafter referred to as the "PPL Act". -The contracting authority shall inform about the prior evaluation of tenders in accordance with Article 139 of the Public Procurement Act - reversed order of evaluation of tenders. In the procedure, the Contracting Authority will first examine and evaluate the tenders, and then make a qualitative selection of the contractor whose tender was the highest rated, in terms of the absence of grounds for exclusion and compliance with the conditions for participation in the procedure. -The contracting authority shall not request the means of proof in question.
