Description

The contract, which is the subject of this opinion, does not constitute a concession within the meaning of Article L.1415-1 et seq. and R.1415-1 et seq. of the General Code of Local Authorities. This is a public service delegation subject to Articles L.1411-1 et seq. and R.1411-1 et seq. of the General Code of Local Authorities.
The purpose of the public service delegation concerns the management of the public collective sewage service throughout the territory of the member municipalities of Cape Town Atlantique, including the maintenance and supervision of waste water treatment works, waste water collection and transport networks and works, the disposal of waste and by-products and the disposal of the sludge produced, the execution of the works entrusted to the Delegate by the contract, the management of relations with the users of the service throughout the duration of the contract and, as an ancillary measure, the maintenance and surveillance of the Cap Atlantic separate rainwater networks and related works.
The service shall be managed by the Delegate at his own risk, in accordance with the laws, regulations and best practice, with a view to preserving the heritage of Cape Town Atlantic, respecting the rights of third parties and the quality of the environment.
The duration of the delegation shall be 8 years from the provisional date of 1.1.2016.
