I.The subject of the contract is the reception and management of municipal waste from entities receiving waste for the benefit of the Association of Wierzyca Municipalities, which come from owners of inhabited real estate and owners of real estate on which there are holiday cottages and other real estate used for recreational and leisure purposes collected from real estate located in the communes of participants of the Association of Wierzyca Municipalities specified in the Model contract and under the conditions described in the detailed description of the subject of the contract constituting Annex No. 1 to the Model contract. II.In accordance with Article 95(2)(1) of the Public Procurement Law, the Contracting Authority requires that activities in the field of operation of sorting lines of installations be performed by persons employed by the Contractor or Subcontractor on the basis of an employment contract. The Contractor is obliged to submit to the Ordering Party a statement by the Contractor or Subcontractor on employment on the basis of an employment contract, persons performing the activities indicated above.The statement should contain information, including personal data, necessary to verify employment on the basis of an employment contract, in particular the name and surname of the employed employee, the date of conclusion of the employment contract, the type of employment contract and the scope of duties of the employee. The Contractor shall submit the first declaration without waiting for the Employer's request within 7 calendar days, counting from the date of commencement of the municipal waste management service.Each subsequent declaration shall be submitted by the Contractor within 7 calendar days from the date of receipt of the relevant request from the Employer. At each stage of performance of the subject of the contract, the Ordering Party has the right to request confirmation by the Contractor of the fact of employing persons on the basis of an employment contract by submitting the declaration referred to above. Failure by the Contractor to submit a declaration within the required period shall be considered by the Contracting Authority as evasion of the obligation to employ persons on the basis of an employment contract and shall result in the imposition of the penalties provided for in §5(5) of the contract. The contracting authority may request an inspection by the National Labour Inspectorate if it has doubts as to the manner of employment of persons operating the sorting lines of the installation. III.Subject to Article 110(2) of the Public Procurement Law, economic operators in respect of which any of the circumstances referred to in Article 108(1) of the Public Procurement Law applies shall be excluded from the procurement procedure. Contractors in respect of whom the circumstances referred to in Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine or Article 7(1) of the Act of 13 April 2022 on special arrangements for countering support for aggression against Ukraine and protecting national security are excluded from the procedure.
