Description

The subject of the contract is the collection of municipal waste from the owners of real estate from sector Nos I, II, III, IV and V. A detailed description of the conditions for the implementation of the subject of the contract is included in the Model Agreement constituting Annex 2 to the FTZ. A detailed description of the subject-matter of the contract is set out in Annex 1 to the contract — Description of the subject-matter of the contract. The Contracting Authority requires the Contractor, during the term of the contract, to meet the requirements specified for the fleet of vehicles used in the performance of this task under the Act of 11 January 2018 on electromobility and alternative fuels and any amendments thereto. 1. If the Contractors jointly apply for a contract, the Single European Procurement Document and a statement on the grounds for exclusion under Article 5k of Regulation (EU) No 833/2014 and Article 7(1)(b) of Regulation (EU) No 207/2009 shall apply. 1 of the Act on special arrangements for counteracting support for aggression against Ukraine and for the protection of national security, shall be submitted by each of the Contractors. The documents confirm the absence of grounds for exclusion and compliance with the conditions for participation in the procedure to the extent that each Contractor demonstrates compliance with the conditions for participation in the procedure. 2. The contractor, in the case of reliance on the capacities or situation of entities making resources available, shall submit together with its self-declaration, also the SED and a statement on the grounds for exclusion from Article 5k of Regulation (EU) No 833/2014 and Article 7(1)(b) and (c) of Regulation (EU) No 833/2014. 1 of the Act on special arrangements to counteract support for aggression against Ukraine and to protect the national security of the entity making resources available, confirming the absence of grounds for exclusion of this entity and, accordingly, compliance with the conditions for participation in the procedure, to the extent that the Contractor refers to its resources. 3. The Contracting Authority informs that the instructions for filling in the ESPD and the editable version of the ESPD form can be found at: https://www.gov.pl/web/uzp/single-European-procurement-document . The Ordering Party recommends filling in the EEDZ using the service available at: https://espd.uzp.gov.pl/. For this purpose, the Single European Procurement Document (SEP) prepared by the Contracting Authority in the *.xml format, constituting Annex 6 to the SPC, should be imported to the above-mentioned service and, following the instructions provided therein, fill in the template of the electronic SEP form. If the authority of the person submitting the tender does not result from the registration documents, the Contractor who submits the tender through a proxy should attach to the tender a power of attorney document covering the authority to submit the tender or to submit the tender and sign the contract. 4. In the case of Contractors jointly applying for a contract, the Contractors shall be required to appoint a representative. The power of attorney document, the content of which will indicate the power of representation in the procurement procedure for these Contractors, must be attached to the tender. 5. The power of attorney shall be attached to the tender and shall contain, in particular, an indication of: - the public procurement procedure to which it relates, - all Contractors jointly applying for the award of a contract named by name, specifying the address of the registered office, - the appointed representative and the scope of his authority. The power of attorney should be submitted in electronic form. It is also permissible to submit an electronic copy of a document certified as authentic by a notary public, i.e. signed with a qualified electronic signature of a person having the powers of a notary public.
