Description

1. The subject of the contract is the maintenance of watercourses located in areas subject to the Management of the Dębem Basin. The Contractor is obliged in all parts to secure the Nature Supervision (before the commencement, or at the latest on the day of commencement of maintenance activities) consisting in conducting a survey of the site for the presence of animal nests covered by species protection and for the presence of protected plant species sites. Natural supervision must be carried out in accordance with applicable law, in particular with the Act of 16 April 2004 on Nature Protection (Journal of Laws No. Journal of Laws 2024, item 1478, as amended), the Environmental Protection Law Act of 27 April 2001 (Journal of Laws No. Journal of Laws 2024, item 54, as amended). 2. A detailed description of the subject-matter of the contract is set out in Annex No 1 to the SWZ containing individually for each part of the subject-matter of the contract: description of the subject of the contract, location maps, measurements of works and common for all parts of Annexes C entitled: ‘List of good practices for contractors’ In addition, before commencing work, the Contractor is required to consult the ‘Catalogue of good practices’ (to the extent corresponding to the work carried out): a) Catalogue of good practices in the field of hydrotechnical works and maintenance works, together with the establishment of rules for their implementation; https://www.gov.pl/web/climate/catalogue-good-practices-robot-hydrotechnical-practices b) Good river maintenance practices; https://www.wwf.pl/sites/default/files/2018-10/Dobre_Practices_maintenance_rzek_wyd_II.pdf (c) Water restoration – a manual of good practices for surface water restoration; https://straznicy.wwf.pl/renaturization-water-handbook-good-practices-renaturization-water-surface/ 3. Contractors who fulfil the following conditions for participation in the procedure may participate in the procedure: 3.1. concerning technical or professional capacity - applies to each part of: a/ (in terms of experience): The Contractor must demonstrate that at least one (1) service has been provided during the last 3 years, counted back from the closing date for the submission of tenders and, if the duration of the activity is shorter, during that period, consisting in the maintenance of natural watercourses and/or canals and/or ditches (excluding ditches at the roadside) and/or flood defences. The above-mentioned service must include at least two types of work among those listed: mowing of slopes, mowing of the bottom, desilting of the bottom, removal of shrubs, removal of fallen trees, demolition of beavers. b/ The Contractor must have at least one (1) person assigned to the nature surveillance function who meets the following cumulative requirements: - holds a university degree or diplomas in one of the following fields: natural sciences and/or agricultural sciences and/or engineering and technical sciences according to the Classification of Scientific Fields and Disciplines and Artistic Disciplines, specified in the Annex to the Regulation of the Minister of Education and Science of 11 October 2022 on the fields of science and artistic disciplines (Journal of Laws, item 2202), and - has experience in performing at least one (1) service of performing natural supervision consisting in performing activities provided for natural supervision, i.e. carried out a survey of the site for the presence of plant or animal sites and/or places of reproduction and/or temporary presence of protected plant or animal species. 4. The Ordering Party requires that the condition specified in point. 3.1. lit. a/ (in pt. 7.2.1. a/ SWZ), was fulfilled in its entirety by one entity (the contractor or the entity making the necessary resources for the contract available to the contractor). 5. Declarations or documents confirming that the Contractor meets the conditions for participation in the procedure: 1/List of services provided, and in the case of repetitive or continuous services also provided, during a period of 3 years counted back from the date on which the deadline for submitting tenders expires, and if the period of activity is shorter, during this period - confirming compliance with the condition set out in point 7.2.1. (a) / SWZ, together with their subject matter (type of work) , dates and place of performance and entities for which these services were provided. The list of services should be drawn up in accordance with the model constituting Annex 9a to the SWZ. 2/Evidence that the services listed in the above-mentioned list of services have been properly performed. The evidence in question shall be references or other documents drawn up by the entity for which the services were provided or, if the economic operator is unable to obtain those documents for reasons beyond its control, a declaration by the economic operator. 3/List of persons assigned by the Contractor to perform the public contract, responsible for environmental supervision. 6. The Contractor shall remain bound by the tender submitted until 13 September 2025. The time limit for binding the tender shall run from the expiry of the time limit for the submission of tenders.
