Description

The AOK – The Health Insurance Fund for Lower Saxony intends, until the entry into force of exclusive contracts, following a public call for tenders in accordance with the regulations of Part 4 of the GWB, non-exclusive pharmaceutical discount agreements for the active substance glatiramer (ATC code: L03AX13) with as much as possible all market participants (pharmaceutical operators or groups of pharmaceutical operators) in the ‘open-house model’.
The Lower Saxony AOK will not take a selection decision and will submit an identical contract offer to each interested pharmaceutical company. The open-house model applies uniform conditions to all participants. Contract content, conditions and access procedures are uniform – in principle no individual negotiation takes place. The maximum duration of the contracts is twenty-four months and the earliest start date is 01/07/2015. All contracts will end no later than 30.6.2017, irrespective of the date on which the contract was concluded. Accession or conclusion of a contract may take place within the twenty-four-month period of the first of each month. There shall be a right of termination six weeks at the end of each month. The Lower Saxony AOK reserves the right to replace the non-exclusive open-house discount agreements with exclusive discounts during the contract period. With the entry into force of tendered exclusive discount contracts, open-house contracts will be terminated in accordance with the contractual arrangements, i.e. the open-house contracts will end automatically. The experience of AOK Niedersachsen after exclusive discount agreements will normally enter into force six to eight months after the publication of the relevant notice of invitation to tender in the Supplement to the Official Journal of the European Union. Future open-house contractors are invited to consult regularly in the Supplement to the Official Journal of the European Union regarding these invitations to tender.

Contracts for the active substance glatiramer are concluded for the first time with effect from 1 July 2015. Interested parties wishing to become contractors on this date must submit the contract documents to the address indicated in the contract documents by 27/05/2015. Access to the Lower Saxony AOK is important. Subsequent contracts may be concluded during the maximum duration of the first month during the twenty-four months. In terms of organisation, AOK must take 35 calendar days in advance in order to ensure the necessary work, e.g. notification of the contract to the Lauer-Taxe®. The exact deadlines for receipt will be announced in the contract documents. This publication does not constitute the award of a public contract within the meaning of the Public Procurement Coordination Directive (2004/18/EC) or public procurement law. In order to ensure the greatest possible degree of transparency with regard to the envisaged conclusion of contracts, it is published in the Supplement to the Official Journal of the European Union. In the absence of a corresponding publication form, the contract notice will be used. The resulting conceptual requirements, such as: The procedure name ‘open procedure’ is solely due to the use of this notice form and the publication platform. There is no other significance, in particular the submission of sub-contracting rules where they are not mandatory for legal reasons.
