Description

1.The subject of the contract is the provision by the Contractor of services specified in Annex 2 to the invitation and contract - Technical conditions and detailed scope of services to be performed for the "EKO-REGION" Sp. z o.o. Plant/Installation in Dylowa A, Pajęczno. 2.The Contracting Authority provides that the subject of the contract will be provided during the hours and in the system described in detail in the Annex to the invitation and No 2 to the contract, subject to the provisions of points 6, 7, 8 and 9. 3.The service covered by the contract will be provided using machines and vehicle rolling stock of the Contractor and the Contracting Authority and by the Contractor's employees, described in detail in the annex to the invitation and No. 2 to the contract. 4.The Ordering Party may also commission the Contractor to perform other works related to the day-to-day operation of the plant, which are not listed in the scope resulting from the Annex to the invitation and No. 2 to the contract, and are necessary to ensure its proper operation. These works will be carried out by the Contractor with the help of machines and vehicle rolling stock and the employees listed in point 3, and the settlement of these works will take place on the terms set out in § 6 of the contract. 5.Due to the specificity prevailing in waste management, the Ordering Party does not guarantee the Contractor the full value of the subject of the contract. During the term of the contract, the Ordering Party guarantees the Contractor the fulfilment of the value range of the subject of the contract in the amount of at least 30%. The reduction of the value scope of the subject of the contract shall not give rise to any claims against the Ordering Party on the part of the Contractor, in particular for payment of remuneration for the unrealised part of the contract and for payment of compensation in connection with the reduction of the value scope of the subject of the contract. An addendum is not required in the present case. 6.The Ordering Party reserves the right to order the Contractor to work on Saturdays. If it is necessary to work on Saturdays, the Ordering Party shall inform the Contractor thereof two days in advance, and in the event of an emergency, eight hours in advance in electronic form, in which it shall specify the working time. The order to work on a Saturday does not require the conclusion of an annex between the Parties, and the settlement of the service will take place in such a case in accordance with § 6 of the contract. 7.The Ordering Party reserves the right to periodically suspend the performance of the service due to the stopping of the sorting line resulting from maintenance and repair works, etc., of which it will notify the Contractor 24 hours in advance. In the event of a failure of the sorting line, the Ordering Party shall immediately notify about the situation and specify the approximate time of stopping the service. The inability of the Contractor to perform the service will not give rise to any claims against the Contracting Authority on the part of the Contractor, in particular for payment of remuneration for the unrealised part of the contract and for payment of compensation due to the inability to perform the service. An addendum to this contract is not required in the present case. 8.The Ordering Party reserves the right to periodically suspend the performance of the service due to the lack of availability of waste, of which it will notify the Contractor 8 hours in advance. The inability of the Contractor to perform the service will not give rise to any claims against the Contracting Authority on the part of the Contractor, in particular for payment of remuneration for the unrealised part of the contract and for payment of compensation due to the inability to perform the service. An addendum to the contract is not required in the present case. 9.In addition to the cases mentioned in points 6, 7 and 8, the Ordering Party reserves the right, after prior written notice to the Contractor, to change the working hours and the number of changes depending on the needs of the Ordering Party, 8 hours in advance in electronic form. The introduction of changes does not require the conclusion of an annex between the Parties, and the settlement of the service will take place in such a case in accordance with § 6 of the contract. 10. The Ordering Party shall settle the service on the basis of actual hours worked, moto-hours, kilometers, courses and man-hours without guaranteeing that the minimum working time will be 8 hours on each of the shifts. 11.The Contractor shall provide a team of staff in a number enabling the performance of the service covered by the subject of the contract at each of the changes listed in the Annex to the invitation and No. 2 to the contract and during the hours specified by the Employer. The description of the subject of the contract is described in detail in the annex to the invitation and No 2 to the contract - Technical conditions and detailed scope of services to be provided. On the day of concluding the contract, the Contractor is obliged to conclude with the Ordering Party, on the terms specified by the Ordering Party, a lease agreement for equipment, machines and devices owned by the Ordering Party. The estimated costs of leasing the Purchaser's equipment are given in the contract documentation, i.e. in the Invitation to negotiate directly.
