Description

A framework contract for the shareholders of PD-Berater der öffentlichen Hand GmbH (hereinafter ‘PD’) is being advertised. In this procurement procedure, PD acts as the central contracting authority for the partner federal states and will initially award the framework contract in its own name, but the partner federal states should be entitled to make the individual calls from the framework contract of PD in its own name and for its own account. The contract is awarded by PD according to the same rules that would also apply to the shareholders' federal states for the corresponding award of the contract, so that the subsequent change of contracting authority does not result in any circumvention of procurement law obligations or a shift in economic equilibrium. The contract will be divided into two lots and awarded with one contractor each, one for the shareholder states from East Germany and one for those from West Germany. The contract includes a basic development with licensing per calling federal state as well as programming of the country-specific adaptations per calling federal state and the subsequent operation and support of the solution per calling federal state for all hospitals and ministries connected there for a basic period of two years from the commissioning (productive operation) of the first project phase of the corresponding state solution, which is extended by a further year, unless the contract should be terminated by one of the parties with a period of at least nine months before the end of the corresponding contractual period. After the end of the second year of the contract, the contractor shall be entitled to adjust the agreed prices for operation and support annually in accordance with the price development pursuant to § 71(3) SGB V for the following years.
