Description

A framework contract for the shareholders of PD -Berater der öffentlichenhand GmbH (hereinafter referred to as ‘PD’) will be put out to tender. PD acts as the central contracting authority for the partner federal states in this procurement procedure and will initially award the framework contract in its own name, but the partner federal states should be entitled to make the individual calls from the PD framework contract in its own name and on its own account. The contract is awarded by PD according to the same rules, which would also apply to the partner federal states for the corresponding procurement, so that there is no circumvention of contractual obligations due to the subsequent change of client, nor a shift in the economic balance. The contract is divided into two lots and awarded with one contractor each, one for the partner federal states from East Germany and one for the partner federal states from West Germany. The contract includes a basic development with licensing per calling state and programming of the country-specific adjustments per calling state and the subsequent operation and support of the solution per calling state for all hospitals and ministries connected there for a basic period of two years from commissioning (productive operation) of the first project phase of the corresponding state solution, which is extended by one further year each, unless the contract is terminated by one of the parties with a period of at least nine months before the end of the corresponding contractual period. The contractor shall be entitled to adjust the agreed prices for operation and support annually after the end of the second year of the contract in accordance with the price development in accordance with § 71(3) SGB V for the following years.
