Germany-Hamburg: Medical aids
The subject of the contract to be performed by the contractor (AN) is the supply to TK-insured persons with four-wheel walking aids (rollers) of product type 10.50.04.1 of the list of aids pursuant to § 139 SGB V, as amended, including upgrades and accessories, as well as the requirements of the tender specifications and annexes.
More specifically, the AN must provide the TK-insured persons with the following four statements:
a. Standard rollers;
b. XXL rollers;
C. Rollers with subarms;
D. Hand-brake rollers.
The above comments are further specified in the product requirements (Annex L1 to the tender specifications).
The scope of the contract depends on the use of TK-insured persons and the physicians’ regulatory behaviour; both factors cannot be influenced by the TK.
The Contractor supplies the TK-insured persons on the basis of a lump sum per execution for a maximum period of five years from the start of the supply period.
In principle, the roller is delivered in person by the Contractor to the TK Insured person’s place of residence.
On a case-by-case basis, delivery may also be required to a hospital, nursing home or another temporary location of the TK-insured person. After the roller has been delivered, further advice is usually provided by telephone. On a case-by-case basis (e.g. in the event of repeated unsuccessful telephone counselling), the Contractor ensures personal advice at the place of residence of the TK-insured person.
As part of the supply flat rate, the Contractor is obliged to carry out any necessary repairs, maintenance and replacements prescribed by the manufacturer within the supply period.
The Contractor assumes all the obligations, including personnel requirements, arising from the Medical Devices Act and other applicable safety regulations for the supply of rollers.
The provisions of the Medical Devices Code of the umbrella associations of health insurance funds and the Bundesverband Medizintechnik e.V. of 12 May 1997, as amended, must be observed and complied with. Paragraph 128(2) of the SGB V shall apply in addition.
