Description

1. The subject of the contract is the performance of a service consisting in the development of a complete design and costing documentation together with obtaining a valid building permit and performing author's supervision for the investment entitled. ‘Modernisation of energy management in the St. John’s Hospital No 2 of the Province Clinical Hospital Jadwiga the Queen in Rzeszów’ 2. The subject of the contract includes the execution of two (2) complete project documentation entitled: 1) ‘Reconstruction and construction of internal sanitary and electrical installations as part of the task ‘Modernisation of the Energy Economy’ at the St. Paul’s Provincial Clinical Hospital in Warsaw. Jadwigi Królowa in Rzeszów,’ 2) ‘Reconstruction and construction of new electricity infrastructure on the premises of the hospital as part of the task ‘Modernisation of the Energy Economy in the St. John’s Provincial Clinical Hospital’. Jadwigi Królowa in Rzeszów,’ and performing author's supervision covering construction works carried out on the basis of the draft documentation, within the deadlines specified in the Schedule. The design documentation will be prepared on the basis of the requirements and comments of the Users provided by the Ordering Party, the Description of the Subject of the Order and on the basis of administrative decisions. 3. The subject of the contract will be carried out according to the following stages: 1) Stage 0 – obtaining all decisions, including the Building Permit Decision or obtaining no objection from the Architectural Administration to the Notification of construction works, obtaining technical conditions (if necessary), arrangements and derogations necessary for the proper performance of the task. Step 0 is closely linked to the other steps. 2) Stage 1 – including the preparation of a multi-industry inventory, the Multi-industry Conceptual Project in accordance with the guidelines set out in the Detailed Description of the Subject of the Order together with all preparatory activities. Stage 1 will be completed by the Ordering Party. 3) Stage 2 – covering works related to the preparation of the Architectural and Construction Project, to the extent necessary to obtain a Building Permit or a Construction Works Application, and Information on Safety and Health Protection, taking into account the guidelines set out in the Detailed Description of the Subject of the Contract, culminating in the acceptance of the Architectural and Construction Project by the Contracting Authority and obtaining a valid Decision on Establishing the Location of the Public Purpose or a Decision on the Building Conditions (if necessary). 4) Stage 3 – covering works related to the preparation of Technical Projects, taking into account the guidelines contained in the Detailed Description of the Subject of the Contract, culminating in the acceptance of Technical Projects by the Contracting Authority. 5) Stage 4 – covering works related to the preparation of Executive Projects, taking into account the guidelines contained in the Detailed Description of the Subject of the Contract, culminating in the acceptance of these projects by the Ordering Party. 6) Stage 5 – covering works related to the preparation of the Technical Specifications for the Execution and Acceptance of Construction Works, Measurements of Works and Investor's Estimates, taking into account the guidelines contained in the Detailed Description of the Subject of the Order, culminating in the acceptance of the Technical Specifications for the Execution and Acceptance of Construction Works, Measurements of Works and Investor's Estimates by the Contracting Authority, 7) Stage 6 – including Author's Supervision at the stage of conducting the Construction Works and equipping the facility, subject to the contractual right of withdrawal by the Contracting Authority from Stage 6 within 3 years from the date of the decision on the approval of the Construction Project and obtaining a final Decision on the construction permit or effective Application for Works – excluding any claims by the Contractor related to the withdrawal from the contract. The detailed list and division of Works within individual Stages (with the exception of Stage 6) is specified in the Detailed Description of the Subject of the Order and the Schedule for the implementation of individual Stages (with the exception of Stage 6). 4. The Contractor is obliged to answer without delay questions concerning the architectural and technical solutions adopted by the participants in a public procurement procedure aimed at selecting the Contractor of Construction Works and providing the Contracting Authority with substantive support or representing it (depending on the decision of the Contracting Authority), if the above-mentioned solutions will be the subject of proceedings before the National Board of Appeal and the Public Procurement Office or other state authorities. 5. Warranty and warranty: The Contractor shall provide the Ordering Party with a guarantee of quality and warranty for the Design Documentation and Works made by him, in particular that it will meet all the criteria set out in the Contract. The warranty period is 3 (three) years and is counted from the date of acceptance of the Facility created on the basis of the Design Documentation for use. 6. Detailed description of the subject of the contract are the following annexes: 1) Description of the subject-matter of the contract and its annexes – Annex 9 to the FTZ; 2) Draft provisions of the public procurement contract and annexes – Annex 10 to the FTZ.
