The contractor should prepare the necessary documentation under the EC procedure of the Strategy and the Medium-Term Operational Programme, including a Report assessing the compatibility with the subject and objectives of conservation of the protected areas. The subject of the contract includes (description of the contract activities): Within the scope of the contract, the Contractor shall carry out the following activities: Action 1: Preparation of a notification to the competent environmental authority in accordance with the requirements of Article 8 of the Regulation on the environmental assessment of plans and programmes; Activity 2: Preparation of terms of reference for the scope and content of the EC report, as well as a scheme for conducting consultations on a draft EC report of the Strategy and the Medium-Term Operational Programme, incl. for their public discussion; Activity 3: Drafting an EC Report on the Strategy and the Medium-Term Operational Programme for Implementation, including an Impact Assessment Report; Activity 4: Participation in public discussion(s) and in a meeting of the Interdepartmental Commission of the Supreme Expert Environmental Council under the Minister of Environment and Water; Activity 5: Preparation of a final report on the EC with the results of the consultations and preparation of a request for an EC opinion; Activity 6 Preparation of a summary report under Article 29(1) of the EA Regulation and a final report on the implementation of the contract; Action 7 Information and communication measures. The activities described above include the implementation of the following services: 1. To prepare a notification to the competent environmental authority in accordance with the requirements of Article 8 of the Regulation on the conditions and procedure for carrying out an environmental assessment of plans and programmes, adopted by Council of Ministers Decree No 139 of 24 June 2004 (EC Regulation). The notification shall be submitted by the Assignor. The competent authority shall determine the applicability of the EC procedure, giving instructions as to the need for it and the action to be taken. 2. If the competent authority so requests, draw up a request for an assessment of the need for an EO containing the information referred to in Article 8a of the EO Regulation. When deciding that an environmental assessment needs to be carried out in accordance with the requirements laid down for the content and scope of the assessment by the competent authority, the Contractor shall proceed to the next procedural steps. 3. To draw up, in agreement with the Contracting Authority, a scheme for consultation with the public, the authorities concerned and third parties likely to be affected by the Strategy and the Medium-Term Operational Programme during the environmental assessment process in accordance with the requirements of Articles 19 and 19a of the EC Regulation. The consultation scheme should comply with the requirements of the EC Regulation and the Regulation on the conditions and procedure for assessing the compatibility of plans, programmes, projects and investment proposals with the subject matter and objectives of conservation of protected areas, adopted by Council of Ministers Decree No 201 of 31 August 2007 (the AA Regulation) (if a report assessing the extent of impact on protected areas is required). The Contractor shall draw up all the materials necessary for carrying out the consultations, together with a summary of the opinions received, observations and proposals accepted and not accepted, and shall include the results of the consultations in the text of the environmental assessment report and its annexes. The contractor should assist the contracting authority in organising and participating in consultations and public hearings, as provided for in the EC Regulation. 4. To prepare terms of reference for defining the scope and content of the EC, which to submit to the Contracting Authority for approval and consultation. 5. Prepare a draft Environmental Assessment Report, including an appended Appropriate Assessment Report, where requested by the competent environmental authority, taking into account the instructions in the letter setting out the applicable procedure or the Decision assessing the need to carry out an environmental assessment, and the results and opinions of the consultations held on the scope and content of the environmental assessment report. 6. Ensure the presence of experts from its team to provide clarifications during the consultations on the EC and GA report. 7. Prepare a final version of the EC report, including the appended compatibility assessment report, where requested by the competent environmental authority, and complete all documentation related to the environmental assessment carried out, as provided for in Article 23 of the EC Regulation. To supplement/rework the EO report in accordance with the instructions of the Contracting Authority until an opinion on an environmental assessment is issued by the Minister of Environment and Water.
