Poland-Warsaw: Network equipment
1. The subject of the contract is the purchase and installation of the necessary hardware infrastructure and system software licences for the construction of the Integrated Information System of the Public Prosecutor’s Office (Stage I), including:
(1) Part I – Extension of PNG hardware and software infrastructure for the implementation of the authorisation of two-factor users of the Public Prosecutor’s Office’s network and information systems; purchase of the necessary equipment and software – Extension of the Contracting Authority’s FortiGate 600C security system by a second device in order to launch the reliability cluster together with the renewal of the service support to its equipment and extension to a secure remote access system,
2) Part II – Extension of PNG hardware and software infrastructure for the implementation of the authorisation of two-factor users of the Public Prosecutor’s Office’s network and information systems; purchase of the necessary equipment and software – Purchase of devices to protect applications and to balance traffic loads,
3) Part III – Extension of PNG hardware and software infrastructure for the implementation of the authorisation of two-factor users of the Public Prosecutor’s Office’s network and information systems; purchase of the necessary equipment and software – Purchase of log collection and correlation equipment from Juniper SRX equipment operated by the Contracting Authority,
4) part IV – Purchase of the necessary hardware and programming infrastructure for the migration of the CBD SIP system from the Ministry of Justice’s data processing environment to the data processing and sharing infrastructure of the Prosecutor General – Extension of the existing blade HP server infrastructure,
5) part – V Purchase of the necessary hardware and programmatic infrastructure for the migration of the CBD SIP system from the Ministry of Justice’s data processing environment to the data processing and sharing infrastructure of the Prosecutor General – Extension of the existing blade Fujitsu server infrastructure,
6) part VI – Purchase of technical infrastructure for the construction and operation of the Data Processing Centre (POPD) of the Public Prosecutor’s Office in accordance with the conditions set out in this ToR, the technical specifications, the model contract, which is set out in Annex 6 to the ToR.
2. The technical specifications of the subject-matter of the contract are set out in Annex 1 – ‘Technical specifications of the equipment’ to the contract.
3. Whenever trademarks, patents or origin, as well as standards, are used in the ToR, including in the description of the subject-matter of the contract, the Contracting Authority shall allow an equivalent solution and reserves the right (where equivalent equipment or equivalent software is offered) to carry out conformity tests in accordance with the rules set out in point. 5.
4. A product equivalent to the specific subject-matter of the contract shall be understood to be a product which properly cooperates with the programmes (application software, business software) held by the Contracting Authority operating in the Microsoft Windows environment, and its use does not require any (financial, software, hardware) expenditure related to the adaptation of the contracting authority’s programmes (applications) or equivalent product, and performs all the functions and features set out in the technical specifications set out in Annex 1 to the contract, which forms Annex 5 to the ToR.
The Contracting Authority’s operating software is Microsoft’s products, i.e. Windows Serwer 2003 operating systems, Windows Serwer 2008, Windows server Data Center, Windows XP, Windows Vista, Windows 7, Kaspersky Antivirus Server and Microsoft Office’s office packets.
5. In case of doubt concerning the Contractor’s compliance with the requirements set out in the ToR (e.g. in the case of offering equivalent equipment or equivalent software), the Contracting Authority reserves the right to request, at the stage of the examination and evaluation of tenders, each of the Contractors to supply the equipment and software covered by the contract to the premises designated by the Contracting Authority in order to carry out the relevant tests. The Contractor will be obliged, at the written request of the Contracting Authority, to borrow the set of equipment offered by the Contractor free of charge within 2 weeks for a period of at least 2 weeks.
The contracting authority will carry out the relevant tests in accordance with the following conditions:
(a) the testing of the kits offered will be carried out by the Contracting Authority’s employees or by a third party (e.g. person(s) of an external firm) chosen by the Contracting Authority (expert within the meaning of Article 21(4) of the Act),
(b) The Contracting Authority reserves the right to test, transport, entrust equipment to third parties for the purpose of carrying out appropriate tests, if it considers this necessary for the proper evaluation of the subject matter of the tender,
(C) a complete set of equipment, identical to that offered in the tender, will be tested. This set will be taken as a model in further proceedings,
(D) the equipment supplied for testing must have all the features listed in the specification.
Failure of any component or incompleteness during the tests disqualifies the equipment. In this situation, the subject matter of the contract will be considered as not fulfilling the conditions of the ToR.
6. An equivalent quality standard means that the products delivered meet certain standards or technical specifications or attests that the Contractor’s activities comply with quality standards or attests that the Contractor’s activities comply with equivalent quality standards referring to quality assurance systems based on the relevant European standards, or attests that the Contractor has applied equivalent quality assurance measures accordingly.
7. Pursuant to Article 25 Point 1(2) of the Public Procurement Act, in order to confirm that the subject of the contract offered meets the requirements laid down by the Contracting Authority, the Contracting Authority shall request the submission, together with the tender, of the technical specifications form completed and signed by the Contractor, in accordance with the technical requirements set out in Annex 1 to the contract – ‘Technical specifications of equipment’ or a form signed by the Contractor in another form.
