Update of the Brandenburg Landscape Programme - Update of the sub-plan "Biological Diversity"

Pursuant to Paragraph 10(1) of the BNatSchG, the trans-local specific objectives, requirements and measures of nature conservation and landscape conservation for the area of a Land are set out in the landscape programme. The tasks and contents of landscape planning are regulated by § 9 para. 1-3 BNatSchG. The landscape programme must be updated as soon as and to the extent that this is necessary in view of the requirements and measures of nature conservation and landscape maintenance, or after 10 years in accordance with the first sentence of Paragraph 4(4) of the BNatSchG. Both occasions are present. The update may take place as a factual sub-plan, provided that the circumstances justifying the update are factually limited (§ 9(4) BNatSchG). In January 2001, the Brandenburg Landscape Programme (LaPro) was established by the highest nature conservation authority, the then Ministry of Agriculture, Environmental Protection and Spatial Planning (MLUR). Due to past and present new developments and new demands on the landscape, such as progressive development, technical installations for the use of renewable energies, climate change or light emissions, the conservation of biodiversity has become a constantly increasing challenge. At the same time, new scientific findings have led to a new state of science and technology in landscape planning and new legal provisions must be observed or implemented. The update serves to implement Sections 1(1)(1), (2), (3)(5) and (6), (4)(2), (5) and (6) of the BNatSchG and is based on its provisions. Care must be taken to ensure that Section 2(2) to (6) of the BNatSchG can be used. The objective sub-plan is intended to develop a spatially specific area backdrop. This is to be presented in a map in the scale M 1:300.000. The map is intended to replace the contents of Map 3.1 of the 2001 Landscape Programme, based on the structure of this map. The map shall be explained in a textual presentation. This should follow the structure of the LaPro 2001 and contain priority objectives, as well as measures to achieve the objectives and a justification of the objectives. The usability according to § 9(3) sentence 2 and § 9(4) sentence 1 BNatSchG and for the strategic environmental assessments in planning by third parties (SEA protected assets must be observed) within the scale level M 1:300,000 must be guaranteed.
