Description

The contracting authority shall allow an equivalent tender to be submitted.
The contracting authority shall allow tenders to be submitted on the basis of solutions equivalent to those designed, applying the same technical and quality standards necessary for the proper functioning of the investment to be procured.
The concept of equivalent materials and equipment should be understood as materials which guarantee that the works are carried out in accordance with the design, and which ensures that the technical, quality and use parameters are not lower than those laid down in the design documentation and technical specifications for the execution and acceptance of the works, and must also be materials and equipment authorised for marketing and use in accordance with the applicable law.
Whenever the subject-matter of the contract is described in this ToR and its annexes with an indication of trade marks, patents or origin, each such indication shall be deemed to be accompanied by the words “or equivalent”.
A contractor who invokes an equivalent solution described by the Contracting Authority shall demonstrate that the materials and equipment it offers meet the requirements laid down by the Contracting Authority.
Failure to indicate in the tender a proposal for equivalent solutions will mean that the subject-matter of the contract will be carried out using the equipment and materials accepted in the technical documentation.
