Description

The contract concerns: Supply of a jaw breaker.
A detailed description of the technical parameters and additional requirements of the Contracting Authority concerning the equipment constituting the subject of the contract is set out in Annex 7 to the ToR.
Requirements of the Contracting Authority concerning the subject matter of the contract:
— the equipment offered must be new (with no traces of use) currently produced on the market,
— the subject matter of the contract must have: the guarantee card, instructions for use, technical approvals, certificates, etc. and the necessary documents required for this type of equipment, and must be provided with all the necessary elements (connectors, cables, etc.) necessary for starting and working with the Contracting Authority for the purpose for which the contract is purchased,
— all documents annexed to the subject-matter of the contract supplied must be written in Polish in printed form.
Warranty and service requirements:
— the warranty period required by the Contracting Authority with a service free of charge for a minimum of 24 months for the equipment and equipment supplied, starting from the date of signature of the protocol referred to in paragraph 6(6). 1 point 2 of the draft contract,
— the guarantee given covers all parts of the equipment supplied and the necessary equipment, excluding consumables which are worn during normal operation,
— the guarantee is an extension of the Contractor’s liability under warranties. The guarantee period shall run with the guarantee period,
— in the case of a maximum of 3 warranty repairs of the same module/component, the Contractor will be required to replace it with a new, fully operational,
— during the warranty period, the Contractor shall arrange for periodic visits by the service engineer (at least once per semester within the time limits set by the parties) in order to carry out a periodic review of the equipment supplied,
— under the warranty given, the Contractor shall provide a technical service and may not refuse to replace an unserviceable part with a new one if the repair does not guarantee the proper functioning of the equipment,
— the reaction time of the service (physical presence of the repairer at the installation site and taking steps to repair the equipment) max within 72 hours (full hours) from the time when the failure was reported,
— the fact that the defects have been remedied will be confirmed on the basis of a mutually signed protocol,
— within 30 days before the expiry of the warranty period, the Contractor shall, in the presence of the Contracting Authority’s representatives, review the equipment supplied free of charge and a record shall be drawn up,
— a full service of the subject-matter of the contract during the post-guarantee period for a minimum of 6 years from the date on which the guarantee ended,
— provision of a guarantee and post-guarantee service covering the subject matter of the contract in Poland.
The technical specifications must include contact details (name, address, telephone, fax, email) of the firm or firms (if more) providing guarantee and post-guarantee services,
— the cost of the service to and from the place where the equipment is used or the transport of the damaged object of the contract to and after repair shall not be borne by the Contracting Authority during the warranty period. The transport of the damaged equipment shall be ensured by the Contractor.
Tenders containing a guarantee period shorter than that required by the Contracting Authority will be rejected in accordance with Article 89(1). 1 point 2).
The guarantee offered by the Contractor, whose tender is considered to be the most advantageous tender, shall automatically become a provision of the contract and shall be counted from the date of signature of the acceptance, commissioning and training report by the representatives of the Contracting Authority and the Contractor.
If, for the items in question, the Contracting Authority has indicated a class, make or trade mark of equipment, it is permissible to offer equivalent equipment subject to strict compliance with the standards, design, parameters and standards which characterise the equipment specified by the Contracting Authority. In this case, it is for the Contractor to prove that the characteristics set out in Annex 6 have been complied with, i.e. each item in Annex 1 to the tender form must be filled in. The evidence provided shall refer to standards, design, parameters and standards and make a comparison which must show that the equipment offered as equivalent is identical or better than that indicated by the Contracting Authority.
Failure to comply with any of the cut-off points for a particular item listed in the Specification.
The technical equipment offered shall result in the rejection of the tender.
