1. The subject of the contract are supplies related to the maintenance of shipping routes in the RZGW in Gdańsk, divided into parts. 2. The contracting authority shall allow partial tenders to be submitted. The contract consists of the following parts: 1) Part 1: Supply of bakeries adapted for night navigation related to the maintenance of shipping routes in the area of ZZ Chojnice; 2) Part 2: Supplies related to the maintenance of shipping routes in the catchment area of Tczew; 3) Part 3: Purchase of materials for shore marking meeting the standards of night navigation at MDW E70 for the Management Board of the Toruń Watershed; 4) Part 4: Purchase of floating signage meeting the standards of night navigation in km 680-736 for the Management of the Toruń Watershed. The detailed scope of the subject of the contract, the conditions for its implementation and the obligations of the Contractor for a given part of the contract include: - Description of the subject-matter of the contract (OPZ) for each lot – Annex No 1 to the FTZ, - Draft provisions of the contract (PPU) – Annex No. 6 to SWZ. 3. The contracting authority does not allow the division of the contract into individual lots. 4. The Contracting Authority does not provide for the possibility of awarding contracts referred to in Art. 1 point 8 of the PPL Act. 5. The Ordering Party does not reserve the obligation for the Contractor to personally perform the key parts of the contract. 6. The Contracting Authority does not specify the activities related to the performance of the contract, which are subject to the requirements of employment by the Contractor or subcontractor of persons who perform activities during the performance of the contract on the basis of an employment relationship. 7. The Contracting Authority does not require the Contractor to employ the persons referred to in Article 96(2)(2) of the Public Procurement Act. 8. The Contractor shall provide the Ordering Party with a guarantee and warranty for defects in the subject of the contract for the period of: 1) for lots 1, 3, 4 orders: 24 months, counted from the date of signature by the Contractor and the Contracting Authority without any comments of the acceptance report, provided that: - the guarantee for the colour of the markings is at least 10 years, - if the manufacturer has provided for a longer warranty period for a given assortment, the Contractor shall provide a guarantee for a given assortment equal to the manufacturer's guarantee. 2) for lot 2 of the contract: 24 months, counted from the date of signature by the Contractor and the Ordering Party without any comments of the acceptance report, with the proviso that if the manufacturer has provided for a longer warranty period for a given assortment, the Contractor shall provide a guarantee for a given assortment equal to the manufacturer's guarantee. 9. All costs related to participation in the procedure, in particular the preparation and submission of a tender, shall be borne by the Contractor submitting the tender. The contracting authority does not provide for reimbursement of the costs of participation in the procedure. 10. The contracting authority reserves the right to cancel these proceedings on the basis of Article 257 of the Public Procurement Act if the funds it intended to allocate to the performance of the contract are not granted to it in whole or in part. The contracting authority is entitled to cancel the procedure for the above-mentioned condition at any stage of the procedure and in respect of selected parts of the contract. The contracting authority retains the right to cancel the procedure on the above-mentioned condition both when it receives unequivocal information about not granting it funds for the performance of the contract, and in the event of delay in obtaining them in relation to the assumed date of performance of the task, if the lack of funds in time prevents the performance of the contract. The Contractor does not have the right to request the Contracting Authority to take action to obtain funds for the performance of the contract, if these will not be granted to him from the assumed source. In the event of annulment of the procedure pursuant to Article 257 of the Public Procurement Act, the Contractors shall not be entitled to reimbursement of any costs of participation in the procedure, including, in particular, reimbursement of the costs of calculation and preparation of the tender and, by participating in the procedure on the terms set out in these documents, the Contractors shall accept without reservation.
