Description

1. The subject of the contract is the performance of the task entitled: “Management and administration of buildings and housing units constituting a resource of the Municipality of Świdnik” including activities of comprehensive management and administration of buildings and housing units constituting a resource of the Municipality of Świdnik. 2. Management and administration shall mean making decisions and carrying out activities aimed at ensuring proper economic and financial management of real estate, servicing users of the resource, ensuring safety of use, proper exploitation of real estate, as well as activities aimed at maintaining real estate in a non-deteriorated state, in accordance with their intended purpose, within the scope of rights and obligations arising from legal provisions, within the limits of the powers of attorney granted, subject to separate legal regulations. In the event of events or threats to the life or health of persons, the safety of property or the environment, resulting from the provisions of construction law, the Contractor makes decisions and performs activities beyond the scope of ordinary management activities, notifying the Ordering Party immediately of these events. 3. Deadline for the execution of the contract: the order will be executed between 1 April 2025 and 30 September 2025. 4. The Contractor shall be responsible for: 1) Performing activities that are incumbent on the landlord in relations between the landlord and the tenant in accordance with the Act on the protection of tenants' rights, the housing stock of the commune and amending the Civil Code (Journal of Laws No. Journal of Laws 2023, item 725) in accordance with § 5 of the model contract for the performance of the task. 2) Performing activities related to the management and day-to-day operation of managed real estate - in accordance with § 6 of the model contract for the implementation of the task. 3) Conducting matters related to the maintenance of buildings and residential premises in proper technical condition and implementation of obligations resulting from the provisions of construction law - in accordance with § 7 of the model contract for the implementation of the task. a) As part of the task, the Contractor will carry out minor, necessary renovation works in residential premises constituting the housing stock of the Municipality of Świdnik, the Contractor will review and replace the window wings and door wings in residential premises constituting the stock of the Municipality of Świdnik: ul. Kolejowa 6/5, Kolejowa 7/13, Kolejowa 6/11, Krępiecka 8/2, Jaworowa 14/22 and Jaworowa 14/24. (b) As part of the task, the Contractor will carry out the necessary renovation works of premises intended for social rent, which are vacant. 4) Preparation of residential premises for sale - in accordance with § 8 of the model contract for the implementation of the task. 5) Conducting, in accordance with applicable regulations, debt collection for the lease of premises - in accordance with § 9 of the model contract for the implementation of the task. 6) Representing the Ordering Party before courts and administrative bodies in the scope of assigned tasks - in accordance with § 10 of the model contract for the implementation of the task. 7) Making settlements with the Ordering Party in the manner specified in § 19 of the model contract.
