Description

1. The subject of the proceedings is a service in the field of technical inspections, adjustment, calibration, calibration, legalization and repairs of: opacimeters, devices for testing the alcohol content in the exhaled air, speed meters and video recorders used in the Capital Police Headquarters, hereinafter referred to as ‘the service’. 2. The Contracting Authority allows partial tenders to be submitted divided into 5 tasks: 1) Task No 1 – Technical inspection, adjustment, calibration and repair of smoke detectors type DS2 operated in units of the Warsaw Police Headquarters 2) Task No 2 – Technical inspection, adjustment, calibration and repair of devices for testing the alcohol content in the exhaled air type Dräger 9510 operated in units of the Warsaw Police Headquarters 3) Task No 3 – Technical inspection, calibration, legalization and repair of laser speed meters type LTI 20/20 operated in units of the Warsaw Police Headquarters 4) Task No 4 – Technical inspection, calibration, legalization and repair of POLCAM video recorders installed in vehicles operated in units of the Warsaw Police Headquarters 5) Task No 5 – Technical inspection, calibration, legalization and repair of VIDEORAPID video recorders installed in vehicles operated in units of the Warsaw Police Headquarters. 3. The detailed description of the subject of the contract is Chapter I. XIX SWZ and Annex 1 to SWZ (suitable for the task). 4. The Contractor, in each task, will be obliged to provide a 12-month warranty and warranty for the replaced parts / components In the event that the manufacturer's warranty is shorter than the minimum required by the Employer, the guarantee provided by the Contractor will be binding on the Parties. 5. The Contractor in task 1, 2 and 3 will be obliged to provide a 6-month warranty and guarantee for the service provided. In task 4 and 5, he will be obliged to provide a 12-month warranty and guarantee for the service provided. 6. Requirements for employment on the basis of an employment relationship in the circumstances referred to in Article 95 of the Act: 1) The Ordering Party requires employment by the Contractor or Subcontractor on the basis of an employment relationship of persons performing the following activities in the scope of contract performance: - technical inspections, adjustments, calibrations and repairs of equipment ; 2) during the performance of the contract, the Ordering Party is entitled to perform control activities against the Contractor regarding the fulfilment by the Contractor or Subcontractor of the requirement of employment on the basis of the employment relationship of persons performing the activities indicated in point 1. In order to verify compliance with these requirements, the Ordering Party is entitled, in particular, to request: a) a statement of the employee employed, b) a statement of the contractor or subcontractor on the employment of an employee under an employment contract, c) a certified copy of the employee's employment contract, d) other documents - containing information, including personal data, necessary to verify employment under an employment contract, in particular the name and surname of the employee employed, the date of conclusion of the employment contract, the type of employment contract and the scope of the employee's duties; 3) The Contractor shall, at each request of the Contracting Authority within the period specified in that request, submit to the Contracting Authority the evidence indicated in point 2 in order to confirm compliance with the requirement of employment on the basis of an employment relationship by the Contractor or Subcontractor of persons performing the activities listed in point 1. Penalties for non-compliance with these requirements shall be specified by the Contracting Authority in Chapter III. XIX SWZ. 4) in case of justified doubts as to compliance with labour law by the Contractor or Subcontractor, the Contracting Authority may request an inspection by the National Labour Inspectorate. 7. Information clause regarding the processing of personal data In accordance with Art. 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (i.e. OJ Urz. EU L 119, 04.05.2016, p. 1), hereinafter referred to as "GDPR", the Contracting Authority informs that: 1) the administrator of your personal data is the Capital Commander of the Police; 2) supervision over the correct processing of personal data is exercised by the personal data protection officer: Dorota Bartkiewicz address: ul. Nowolipie 2, 00-150 Warsaw; e-mail address: iod@ksp.policja.gov.pl 3) Your personal data will be processed on the basis of Art. 1 lit. c GDPR for the purpose related to the public procurement procedure conducted under the open tender procedure entitled: Technical inspection, adjustment, calibration, calibration, verification and repair service: opacimeters, devices for testing the alcohol content in the exhaled air, speed meters and video recorders used in the Capital Police Headquarters, ref.: WZP-395/25/40/Z; 4) the recipients of your personal data will be persons or entities to whom the documentation of proceedings based on Article 18 and Article 74 sec. 1 of the Act; 5) Your personal data will be stored, in accordance with Article 78 of the Act, for a period of 4 years from the date of completion of the procurement procedure, and if the duration of the contract exceeds 4 years, the storage period covers the entire duration of the contract; 6) the obligation to provide your personal data directly concerning you is a statutory requirement specified in the provisions of the Act related to participation in the public procurement procedure; the consequences of failure to provide certain data result from the law. 7) The Contracting Authority provides for the cancellation of the procedure if the public funds that it intended to allocate to finance the contract are not awarded.
