Supplement to H5 contract for change of salary sub-indices
The transport company Movia has entered into supplementary agreements to adjust the indexation mechanism for wage sub-indices in the contracts concluded following the invitation to tender for port bus services – H5. For the same contracts, and after thorough investigations and dialogue with the market, the transport company Movia has previously switched sub-indices for wages from ILON12, TOT total, seasonally adjusted, to SBLON1, TOT total, Companies and organisations ("Additional Agreement 1"), as due to the technical handling of the high inflation in Statistics Denmark's calculation of ILON12, TOT total, seasonally adjusted, there had been a significant difference between the development in ILON12, TOT total, seasonally adjusted, and the development in the actual wage costs of the operators. This meant that, contrary to its purpose, the index did not take sufficient account of the real increase in the labour costs of operators. Since then, the ILON12 index has also been discontinued. The index replacement took place with Q3 2024 as the conversion time. Index replacement has proved insufficient, as SBLON1, TOT business in total, Companies and organisations, since the Parties concluded Supplementary Agreement 1 has developed significantly weaker than the actual labour costs of the operators. This results in (i) that the operators have already realised losses, (ii) that this loss will continue to increase over the duration of the contracts and (iii) that the contracts will thus fail for the operators, causing them a real risk of having to abandon the contracts, leaving Movia without critical operator coverage and with a serious security of supply problem. The background to the conclusions is analyses prepared by third parties, including both an analysis of the loss incurred and a sensitivity analysis that includes different scenarios for the future difference between the development of SBLON1 and the actual labour costs of the operators. Against this background, the Danish transport company Movia has made new assessments of how the actual development in wage costs can be reflected in the indexation. For this purpose, the Transport Company Movia has also been commissioned by third parties to carry out analyses. On the basis of these circumstances, Trafikselskabet Movia has concluded supplementary agreements on further adjustments to the indexation of the contracts.
