Description

The subject of the contract is the provision of services for the collection and management of municipal waste from the territory of the municipality of Jaworze - from owners of residential properties and non-residential properties used for recreational and leisure purposes - in the period from 01.01.2027 to 31.12.2027. As part of the implementation of the subject of the contract, the Contractor will be obliged to transfer unsorted (mixed) municipal waste to a municipal installation providing treatment referred to in Article 35 sec. 6 point 1 subject to Art. 4 of the Waste Act of 14 December 2012 (consolidated text: Dz. Journal of Laws 2023, item 1587 as amended). For other separately collected waste, the waste hierarchy referred to in Article 17 of the Waste Act applies. Receipt and management should be carried out in such a way as to ensure that appropriate levels of preparation for re-use and recycling of municipal waste, levels of landfilling of municipal waste and levels of reduction in the weight of biodegradable municipal waste sent for landfill are achieved, in accordance with the applicable legal provisions - including the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (consolidated text: Journal of Laws of 1996, No. Journal of Laws of 2025, item 733), the Waste Management Plan for the Silesian Voivodeship and the Regulations for maintaining cleanliness and order in the Jaworze Commune and a resolution of the Jaworze Commune Council on the detailed method and scope of providing services in the field of collecting municipal waste from property owners and managing this waste, in exchange for a fee paid by the property owner for the management of municipal waste. The contract provides for the collection of municipal waste from owners of residential properties and non-residential properties used for recreational and leisure purposes in the municipality of Jaworze and their management in the period from 1 January 2027 to 31 December 2027. The contractor will be required to transfer unsorted (mixed) municipal waste and biodegradable waste to a municipal installation providing the treatment referred to in Article 35(1)(b) and (c) of Regulation (EC) No 207/2009. 6 point 1, subject to Art. 4 of the Waste Act of 14 December 2012 (consolidated text: Dz. Journal of Laws 2023, item 1587 as amended). For other separately collected waste, the waste hierarchy referred to in Article 17 of the Waste Act of 14 December 2012 applies. The contractor will hand over the waste to an authorised installation in accordance with the management rules laid down in the Waste Act of 14 December 2012 (consolidated text: Journal of Laws of 2012, item 926, as amended). Journal of Laws 2023, item 1587 as amended) and in keeping with the waste hierarchy referred to in Article 17 of the Act. According to Art. 4 point 5 of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (consolidated text: Dz. Journal of Laws of 2025, item 733) The Ordering Party obliges the Contractor to indicate the installation in the tender. Note 1: The contracting authority shall require the Contractor to achieve a minimum level of preparation for re-use and recycling of municipal waste of 57% in 2027, as referred to in Article 3b(1)(b) EUTMR. 1 point 5 of the Act on maintaining cleanliness and order in municipalities. Note 2: A detailed description of the performance of the service is contained in Annex No 20 to the SWZ – ‘Specification of the service for a contract for the provision of a service consisting in the collection and management of municipal waste from real estate and from cottages or other real estate used for recreational and leisure purposes located in the municipality of Jaworze’ (Detailed Description of the subject-matter of the contract).
