Description

1. The subject of the contract is the provision by the Contractor to the Contracting Authority of maintenance services for the digital radiography system Agfa DR (hereinafter referred to as: medical equipment) in order to keep it ready for work in accordance with the draft provisions of the contract constituting Annex 4 to the FTZ. 2. A detailed description of the subject of the contract is included in Annex 3 to the FTZ. 3. The Ordering Party reserves that if the medical equipment covered by the subject of the contract during the term of the contract is temporarily or permanently excluded from operation (in particular due to its improper technical condition and the inability to repair the device due to the lack of spare parts or for other reasons, which will be determined by the Contractor by an appropriate technical ruling), as well as if during the term of the contract the Ordering Party disposes of serviced medical equipment, of which the Ordering Party will inform the Contractor in writing or by e-mail, the contract will expire. In this case, the Contractor shall not be entitled to remuneration for the provision of maintenance services or any other claims against the Ordering Party on this basis, to which the Contractor does not raise any objections. The Contracting Authority informs that in the procedure in question, conducted under the open tender procedure, it provides for the possibility of using the procedure referred to in Article 139 sec. 1 of the Public Procurement Act, using the above procedure, the Contracting Authority will first examine and evaluate the tenders, and then make a qualitative selection of the Contractor whose tender was the highest rated in terms of the lack of grounds for exclusion and compliance with the conditions for participation in the procedure.
