Description

1. The Contractor shall be bound by the tender until 13 December 2025, the first day of the time limit for the submission of tenders being the day on which the time limit for receipt of tenders expires. 2. 1. The subject of the contract is: Purchase and delivery of brand new non-marked BUS 9 type official vehicles – passenger for the purposes of the Radom Provincial Police Headquarters – in the amount of 20 units with option rights (max 10 units). 2. The Contractor sells and undertakes to deliver, by his own transport and at his own expense, 20 (twenty) brand new (production year 2025) passenger-ready vehicles with a maximum permissible laden mass (GVW) of not more than 3500 kg under a basic (guaranteed) contract. 3. For delivered vehicles, the Ordering Party requires the Contractor to grant the warranty specified in the TECHNICAL SPECIFICATION, with the proviso that the Ordering Party requires that the subject of the contract be covered by the warranty for mechanical, electrical and electronic components of the vehicle for a minimum period of 36 months with a limit of 120 000 km of mileage. 4. The Customer requires that the delivered vehicle be made in accordance with: a) the technical specification, which is Annex 1 to the contract b) the principles of technical knowledge, generally applicable standards and standards in this field, taking into account the applicable regulations, c) had the required attestations and approvals in the field of utility values. 5. On the day of delivery of the vehicle, the Contractor shall provide the Ordering Party with the complete documentation indicated in the technical specification. 6. Place of delivery/collection of the vehicle: Provincial Police Headquarters with its registered office in Radom, ul. 11th November 37/59 26-600 Radom 7. Right of option: 1. The contracting authority envisages exercising the right of option depending on obtaining additional funding or savings from other tendering procedures. 2. The contracting authority provides for the possibility of exercising the option to increase the scope of the contract for the purchase and delivery of a maximum of 10 vehicles. 3. The gross unit prices of vehicles purchased under the option will be identical to the price of the vehicle of the basic order. 4. The number of ordered vehicles under the option right is decided by the Ordering Party. 1. Vehicles purchased under the option will meet the requirements of the Technical Specifications set out in Annex 1 to the contract and in accordance with the Contractor's offer and the tender documentation. 2. In order to exercise the right of option, the Ordering Party shall provide the Contractor with a statement on the exercise of the right of option, in electronic form, together with the number of vehicles, on the date of performance of the contract for the delivery of vehicles for the basic contract. The declaration in electronic form will be sent to the Contractor’s e-mail address. 3. The Contractor shall not be entitled to any claim against the Ordering Party in the event that the Ordering Party does not exercise the right of option. Execution of the contract covered by the option is only the Employer's right. 8. A detailed description of the subject of the contract is included in: 1) Annex 1 to the FTZ – TECHNICAL SPECIFICATION for an unmarked business vehicle type BUS 9-seater 2) Annex 2 to the FTZ – draft provisions of contract V. Information on the means of proof in question submitted together with the offer: 1. In order to confirm the compliance of the offered deliveries with the requirements specified by the contracting authority, the contractor is obliged to WITH THE OFFER: 1) a statement by the contractor regarding the fulfilment of the warranty conditions for the elements listed in the statement, a model of which is attached as Annex 3 to the FTZ; 2) a statement by the contractor regarding the fulfilment of technical conditions, a model of which is attached as Annex 4 to the FTZ; 3. copies of the EC certificate of conformity of the vehicle 2. If the economic operator fails to submit the evidence in question together with the tender, or if the evidence in question is incomplete, the contracting authority shall request the economic operator to submit or supplement it within the prescribed period. 3. The means of proof and other documents or statements drawn up in a foreign language shall be provided together with a translation into Polish. A translation shall not be required if the contracting authority has given its consent in the cases referred to in Art. 3 of Law 4. The contractor shall submit the evidence and other documents or declarations referred to in the Regulation in electronic form, in electronic form with a qualified electronic signature, in written form or in document form, to the extent and in the manner specified in the provisions issued pursuant to Article 70 of Act 2) The reason for not subdividing the contract into lots: The contracting authority decided not to divide the contract into lots. In the contracting authority’s view, this Decision will not affect fair competition by awarding contracts to smaller operators, in particular small and medium-sized enterprises. The subject of the contract is indivisible, it is one type of vehicle in the amount of 20 pieces with the right of option up to a maximum of 10 pieces. Dividing the contract into lots would be artificial. The division would risk excessive difficulties in the performance of the contract and a likely increase in the value of the subject-matter of the contract.
