Description

The purpose of the contract is to provide services with mechanical ventilation, in accordance with Article 59 of Legislative Decree No 163/2006 in conjunction with the legal framework laid down in Ministerial Decree No 332/99, with the lowest price criterion.
This procedure is justified by the legal framework laid down by Ministerial Decree No 332/99 (Article 8.1), which allows the authorities, as clarified by Section V of the Council of State, by judgment No 1353/OR, to determine, after the use of public tendering procedures, not the individual successful tenderer, but only the most favourable price of a given health protection.
