Description

I. The subject-matter of this public procurement procedure is the purchase of a robotic surgery system with equipment, associated devices, training and warranty and service services for the John Paul II Provincial Hospital in Bełchatów, in accordance with the detailed description of the required technical parameters of the medical equipment covered by the contract, which the Contractor is required to provide, install/install and run, in accordance with the description of the subject-matter of the contract, which is Annex 2.1 to the FTZ - Required technical parameters and Annex 2.2 to the FTZ - TECHNICAL PARAMETERS SUBJECT TO THE ASSESSMENT IN THE OFFER EVALUATION CRITERIA (if applicable). II. WARRANTY PERIOD: is 60 months. The Contractor shall provide a quality guarantee and warranty for defects for a period of 60 months, calculated from the date of signing the final acceptance protocol for the subject of the contract. Detailed terms and conditions regarding the guarantee and warranty are set out in the draft provisions of the agreement, which constitute Annex No. 4 to the FTZ. III. EQUIVALENCE - in relation to all standards, European technical assessments, approvals, technical specifications and reference systems and certificates indicated and required in the FTZ, the Contracting Authority allows equivalent solutions. The names given by the Ordering Party, trademarks are exemplary, and their indication is aimed at determining the expected standard. The contracting authority shall allow equivalent tenders to be submitted. As an ‘equivalent product’, the Contracting Authority will consider a product with no worse technical parameters than those indicated in the description of the subject-matter of the contract. The Ordering Party reserves that wherever trademarks, patents or origins, sources, detailed processes or technologies that characterize products or services provided by a specific Contractor, standards, European technical assessments, approvals, technical specifications and technical reference systems are indicated in the content of the documentation constituting the subject of the contract - the Ordering Party allows methods, materials, devices, systems, technologies, standards, specifications, etc. equivalent to those presented in the description of the subject of the contract. It is therefore permissible to propose in the offer any equivalent market equivalents with properties not inferior to those indicated by the Employer. The parameters of the standard specify the minimum technical, operational, operational, quality and functional conditions to be met by the subject-matter of the contract. Indicated trademarks, patents, brands or names of the manufacturer or sources or specific processes, standards, European technical assessments, approvals, technical specifications and technical reference systems indicating origin, specify only the class of products, methods, materials, equipment, systems, technologies, standards, European technical assessments, approvals, technical specifications and technical reference systems, etc. The offer may include methods, materials, devices, systems, technologies, etc. of other brands and manufacturers, but with technical, quality and functional parameters corresponding to the methods, materials, devices, systems, technologies, standards, European technical assessments, approvals, technical specifications and technical reference systems, etc. described in the FTZ. The contracting authority points out that, in accordance with Art. 5 of the Public Procurement Act, the burden of proving that the offered subject of the contract is equivalent to the requirements specified by the Ordering Party in the PZP rests on the Contractor submitting the tender. The general principles of equivalence are set out in the Annex to the FTZ.
