In accordance with Article 160 of Law No 98/2016, economic operators have the right to request clarifications in relation to this tender documentation, via SICAP, at least 20 days before the deadline for submission of tenders, by accessing the ‘Claims for clarification / Questions’ section. When entering the title and content of the question, the identity of the economic operator will not be indicated/presented.
In accordance with Article 161 of Law 98/2016, in so far as requests for clarifications or additional information have been sent within the prescribed time limit, the contracting authority will publish the answers, together with the related questions, and/or additional information, in SICAP, attached to the contract notice in the section ‘List of clarifications, notifications and decisions’, 13 days before the deadline set for the submission of tenders, taking steps not to reveal the identity of the tenderers who requested those clarifications or additional information.
The contracting authority will ask the tenderer ranked first, after applying the award criterion, to submit supporting documents demonstrating the fulfilment of the qualification and selection criteria, in accordance with the information contained in the ESPD. In accordance with Article 66(1) of Government Decision No 395/2016, where the tenderer ranked first does not duly demonstrate that all the criteria have been met in full, the contracting authority shall require the tenderer ranked next to it to submit all the supporting documents in order to verify that the qualification criteria have been met.
If the documents submitted by the economic operators are incomplete or if there are uncertainties, the contracting authority has the right to ask the tenderers for clarifications, clarifications, additions to the documents. These will be addressed via SICAP in the "Clarification Requests/Questions" section. The contracting authority is not entitled to change the requirements and essential elements set out in the tender documentation by means of the clarifications/additions requested.
