PL-Jerzmanowice: Sewage, refuse, cleaning and environmental services
The subject-matter of the contract is the provision of a service for the collection of municipal waste from the owners of the properties on which residents live, located in the municipality of Jerzmanowice-Pruginia and the management of that waste.
In the context of the contract, it is the collection and management of the entire stream of municipal waste sent by the owners of the properties located in the municipality of Jerzmanowice- Przeginia, where residents live, in such a way as to ensure that appropriate levels of recycling, preparation for re-use and recovery by other methods are achieved and that the weight of biodegradable municipal waste sent to landfill as part of the task entrusted is reduced, in accordance with the provisions of:
— Act of 13 September 1996 on the maintenance of cleanliness and order in municipalities (Journal of Laws 1996) Of Laws 2012, item 391, as amended),
— Resolution of the Małopolskie Provincial Assembly No XXV/397/12 of 2 July 2012 – Małopolskie Province Waste Management Plan,
Regulation of the Minister for the Environment of 11 January 2013 laying down detailed requirements for the collection of municipal waste from property owners;
— the Waste Act of 14 December 2012 (Journal Of Laws 2013, item 21).
The contractor is obliged to hand over mixed municipal waste and green waste to an installation which has the status of a regional or substitute facility for the treatment of municipal waste for the West Region, which includes the municipality of Jerzmanowice- Przeginia in accordance with the Waste Management Plan for Małopolskie Province (approved by Resolution No XXV/397/12 of 2 July 2012) in accordance with the Act on the maintenance of cleanliness and order in municipalities (i.e.: Of Laws 2012, item 391, as amended)
A detailed description of the subject matter of the contract is set out in Annex 8 – description of the subject of the contract
I. The collection of waste directly from residential properties will be carried out by waste:
(1) mixed municipal waste,
(2) paper,
(3) plastics, multi-material packaging,
4) metal,
(5) glass,
6) biodegradable waste, green waste
7) furniture and other bulky waste.
II. Containers for the collection of municipal waste:
1) containers (cabs) for mixed waste of a capacity of 120 l, 240 l
2) transparent polyethylene bags (PE-HD, PE-LD, LPHE) and thickness ensuring the strength of the bags, i.e. at least 60 microns per separately collected waste, of a capacity of 120 l,
in the following colours:
(a) blue, can be marked with the word “Paper” – for use on paper,
(b) green, may be marked with the word ‘Class’ – for colour glass,
(C) white, may be marked ‘Class’ – for colourless glass,
(D) yellow, may bear the inscription ‘Plastics’ – for plastic and multi-material packaging,
(D) red, may be marked “Metal” for metal,
(e) brown, can be marked with the word ‘Biowaste’ – for waste
biodegradable.
(3) multi-family segregated waste containers may be used interchangeably in buildings instead of coloristic bags adopted as for bags.
III. Breakdown of containers according to population:
1-4 persons: 120 l
5-7 arrivals: 240 l
8-11 arrivals: 240 l and 120 l
12-15 arrivals: 2 x 240 l
IV. Frequency of receipt of municipal waste from immovable property:
(1) mixed municipal waste:
single-family buildings – once a month;
(2) separately collected waste from paper, glass, metal, plastic and multi-material packaging,
single-family buildings on a monthly basis,
Biodegradable waste:
single-family buildings – every two weeks from 1 May to 30 September, every three weeks from 1 October to 30 April,
4) bulky waste, tyres twice a year
5) waste electronic and electrical equipment on a quarterly basis.
V. Obligations of the Contractor with regard to the fitting-out of properties inhabited in containers and bags.
(1) The Contractor is required to equip residential properties with containers for the collection of mixed municipal waste and separate waste collection bags.
(2) The first fitting of containers and bags to the property must take place by 30 June 2013 and then be carried out on an ongoing basis throughout the duration of the contract. Time limit for delivery of containers during the duration of the contract: as soon as possible, but not later than 3 working days from the date of acceptance of the notification. The contracting authority reserves the right to require that the properties be retrofitted in the event of their proven disappearance or destruction.
(3) The Contractor will indicate a telephone number and an e-mail address at which residents will be able to report by telephone or electronically the need for containers for mixed municipal waste and bags.
4) Estimated number of containers for the collection of municipal waste with which the Contractor will equip residential properties:
— 1900 containers 120 l
— 1100 containers of 240 l (or alternatively 2 containers 120 l for each 240 l container)
Waste containers shall be new or in good working order (used) in accordance with the applicable standards.
5) Estimated quantity of municipal waste collection bags with which the Contractor will equip residential properties:
(a) blue for paper – 6000 items.
(b) green for colour glass – 50000 pieces.
(C) white for colourless glass – 65000 units.
(D) yellow for plastic and multi-material packaging – 65000 items.
(D) red for metal: 5500 items

When drawing up its tender, the contractor must take into account the increasing trend in the number of residential properties covered by this contract for the period 2013-2015.

2.The municipality of Jerzmanowice-Province is characterised by a single-family building.
3.The population density for the municipality of Jerzmanowice-Krugne is 158,19 inhabitants/km².
4.Cilometry of roads totals 119.7 km, of which:
1) national road 9.7 km (the national road DK94 is covered by the Viatol system)
2) district roads 25 km,
3) municipal roads 85 km.
Paved roads account for 80 %.
VII. Transport and fitting-out – The Contractor shall:
(1) the protection of the waste transported against dumping,
(2) the collection of bulk waste next to filled containers, containers located in multi-dwelling buildings and the bringing of adjacent areas, i.e. areas within a radius of 4 metres, contaminated as a result of the overcrowding of the aforementioned collection facilities – this obligation must be implemented as soon as the containers or containers are empty,
(3) the export of waste also where it is established that parking vehicles are unable to reach the container or other obstacles,
4) the transfer of collected mixed municipal waste and green waste to a facility which has the status of a regional or substitute municipal waste treatment facility for the West Region of which the municipality of Jerzmanowice-Transfusion belongs in accordance with
the Waste Management Plan for the Małopolskie Voivodship,
5) transfer of separately collected municipal waste collected from owners of residential properties to waste recovery and disposal facilities, in accordance with the waste hierarchy referred to in Article 7 of the Waste Act of 14 December 2012 (Journal of Laws Of Laws 2013, item 21),
(6) the management of waste collected in such a way as to ensure that the contracting contractor fulfils the obligations imposed by the Act of 13 September 1996.

regulations issued on the basis of Articles 3b(2) and 3c. 2 of the above-mentioned Acts, i.e.:
— Regulation of the Minister for the Environment of 29 May 2012 on recycling rates, preparing for re-use and recovery by other methods of certain fractions of municipal waste (Journal Of Laws 2012, item 645),
— Regulation of the Minister for the Environment of 25 May 2012 on levels of reduction in the weight of biodegradable municipal waste sent to landfill and the method of calculating the level of reduction in weight of such waste (Journal Of Laws 2012, item 676),
— Regulation of the Minister for the Environment of 11 January 2013 on detailed requirements
as regards the collection of municipal waste from property owners (Journal of Laws Of Laws 2013, item 122).
VIII. THE CONTRACTOR’S OBLIGATIONS INCLUDE IN PARTICULAR:
Performance of the subject-matter of the contract in accordance with the applicable legal provisions and:
(a) Preparation of export schedules in the form of leaflets (black-white, 2950 pieces) and distribution to residents. The leaflets must indicate, in particular, the address and telephone number of the municipality to pay the fee and the time limits for payment of the fee. A proposal for a schedule of exports for 2013 must be submitted to the Contracting Authority by 14 June 2013 and for 2014 by 20.12.2013 and for 2015 by 20 December 2014. Schedule distribution:for 2013, it should take place by 21 June 2013, 2014 to 5 January 2014 and for 2015 to 5 January 2014.
(b) Preparation and distribution of a timetable for the collection of bulky waste, mobile points (black-white, 2950 pieces) for the entire duration of the contract until 30.6.2013.
NOTE: By distribution, the Contracting Authority understands:
in single-family buildings, providing the above-mentioned information to the mailboxes,
(C) The Contractor is required to provide a service relating to the fitting-out of buildings inhabited in containers for the collection of mixed municipal waste and bags.
(D)The first fitting of containers and bags to the property must take place by 30 June 2013 and then be carried out on an ongoing basis throughout the duration of the contract. Time limit for delivery of containers during the duration of the contract: as soon as possible, but not later than 3 working days from the date of acceptance of the notification. (e) Ensuring that appropriate levels of recycling, preparing for re-use and recovery are achieved by other methods and reduce the weight of biodegradable municipal waste sent to landfill in accordance with Article 3. 2 points. 7, 3b and 3c of the Act
of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal Of Laws 2012, item 391), Regulation of the Minister for the Environment of 29 May 2012 on recycling rates, preparing for re-use and recovery by other methods of certain fractions of municipal waste, Regulation of the Minister for the Environment of 25 May 2012 on levels of reducing the weight of biodegradable municipal waste sent
for landfilling and the method of calculating the level of reduction in weight of that waste, within the scope of the task assigned.
(F) The collection of waste must take place according to a fixed timetable on fixed days of the week,
except Sunday.
(g) During the performance of the contract, the Contracting Authority provides for two times a year to collect large waste and used tyres.
(H) The Contractor shall provide mobile waste collection points for the duration of the contract.

(2) Reporting – The Contractor must:
(a) keeping quantitative and qualitative waste records in accordance with the provisions of the Waste Act and the Act on the maintenance of cleanliness and order in municipalities.
(b) forward to the Contracting Authority, throughout the duration of the Contract, monthly reports no later than the 20th day of the month following the accounting month containing information on:
— the quantity and type of municipal waste (quantity and capacity of containers and number of fraction bags) collected from specified properties,
— the quantity and type of municipal waste (Mg broken down by fraction) received by MPZOK,
— the amounts of construction and demolition waste (Mg) collected from individual properties,
— quantities and types of bulky, electrical, electronic and hazardous waste
(Mg split into fractions) received during touring collection,
— quantities of overdue medicines and batteries (Mg by fraction),
— the method of waste management, indicating the facility to which it was sent, as evidenced by waste transfer cards,
(C) forwarding to the Contracting Authority, throughout the duration of the Contract, a quarterly report in accordance with Article 9n. 1-3 of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (i.e. Journal Of Laws 2012, item 391, as amended) and the Regulation of the Minister for the Environment of 15 May 2012 (Journal Of Laws 2012, item 630) on the model for reports on municipal waste collected, waste collected and the implementation of municipal waste management tasks, by the end of the following month
after the quarter to which it relates.
(3) Control of the accuracy of segregation:
The contractor is required to notify the Municipality in the event of failure by the property owner to comply with its obligation to collect municipal waste separately.
The contractor receiving municipal waste shall:
— keep information on badly segregated waste for the owner of the property,
— take photographic documentation with a date stamp together with the incident report,
— inform the Contracting Authority immediately of this fact.
IX.INAL OBLIGATIONS OF THE CONTRACTOR:
(1) the performance of the subject-matter of the contract in a manner which does not create unnecessary obstacles or inconvenience for the inhabitants of the municipality,
(2) ensuring, for the proper performance of the subject-matter of the contract, throughout the duration of the contract, sufficient technical means to guarantee the timely and qualitative performance of the physical scope of the service, at least as in the tender submitted in the tender procedure,
(3) the treatment of land contaminated with waste discharged from containers, containers, bags and vehicles during the performance of the collection service,
4) equipping own waste export workers with protective clothing
with a visible logo of the company,
5) equipping vehicles for waste collection (including segregated waste) with a monitoring system based on a satellite positioning system (e.g.: GPS), which shall be able to record permanently the position of the vehicle and the berths and a sensor system recording data on waste landing sites,
(6) recording in a manner that makes it possible to read and store at the Contractor’s premises, for the duration of the contract and one year after the end of the contract, data from the monitoring system and sensor system. The contractor must have an appropriate programme for reading, presentation and analysis of the stored data, which should be made available whenever the Contracting Authority so requests,
7) the collection and transport of waste, including in cases where access is made
property will be more difficult (due to road refurbishment, bad weather commuting, etc.). The contractor is not entitled to claim an increase in the costs of performance of the contract;
8) production, at the request of the Contracting Authority, of any documents proving performance of the subject matter of the contract in accordance with the requirements and legal provisions laid down by the Contracting Authority,
(9) assuming full liability to the Contracting Authority and to third parties for damage to property
and the health of third parties arising during and in connection with the implementation of the subject matter of the contract,
(10) repairing or bearing the costs of repairing damage caused by the municipal waste disposal service in the municipality (damage of pavements and other facilities),
11) repair or replacement of containers and waste containers damaged during performance of the contract, at his own expense, if caused by the Contractor’s fault, within 3 days of notification
by telephone or e-mail by the Contracting Authority,
(12) carrying out an information campaign at least three times on the territory of the municipality – distribution of information prepared by the Contracting Authority (leaflets providing information on the means of segregation, as regards the correct treatment of waste),
(13) providing all residential property owners with a timetable for the export of municipal waste by 21 June 2013 and each time it is changed,
(14) If, during the term of this contract, the resident of the Municipality of Jerzmanowice-Persuance does not wish to equip his property with a container or segregated bags, the Contractor shall be discharged from this obligation after obtaining a written declaration from the owner of the property,
(15) the provision of at least one telephone number for rapid communication so that a representative of the Contracting Authority can contact the Contractor on a permanent basis,
16) The contracting authority shall, upon conclusion of the contract, make available to the Contractor a list of the address points needed to equip the appropriate number of containers,
17) The Contracting Authority will keep the Contractor informed of the properties on which waste generation has been discontinued in accordance with the declaration submitted by the property owner within 14 days after the Contracting Authority has obtained the information.
X. Separate collection point for municipal waste (PSZOK) – mobile
The contractor is required to provide a mobile municipal waste collection point for residents of the municipality of Jerzmanowice- Przemunia, hereinafter referred to as MPZOK, which complies with the following conditions:
(1) MPZOK shall be equipped with at least 2 mobile containers placed in a place accessible to all residents of the Municipality,
(2) the mobile point must be set every Saturday between 800 and 1600 at a location indicated by the Contracting Authority in different parts of the Municipality, so as to enable residents of individual parishes to deliver the municipal waste generated locally at least once a month,
(3) ensuring the free collection of municipal waste collected separately from property owners living in the municipality of Jerzmanowice- Przeginia:
— paper, multi-material packaging, glass, plastics and metal,
— biodegradable green and kitchen waste,
— bulky waste and waste electrical and electronic equipment,
— overdue medicines,
— waste batteries and accumulators,
— worn tyres,
— chemicals, i.e. paints, worked oils, inks, adhesives, solvents, etc.
— construction and demolition waste arising from renovations and other self-construction works for which no building or demolition permit is required, and for which notification to the architectural administration is not required,
4) to ensure free distribution to persons who prove that they are the owners of a property resident in the municipality of Jerzmanowice- Przeginia, bags for separate collection of waste and for biodegradable waste, of a capacity and colouring meeting the requirements laid down in the regulations for maintaining cleanliness and order in the municipality.
5) The Contractor shall, outside the agreed timetable for the export of separately collected waste and biodegradable waste, collect from the residents the filled bag with such waste delivered in person
and issue a new bag upon request,
6) The Contractor is required to supervise the mobile point and maintain cleanliness and order around
the above-mentioned point after collection has been completed,
7) cars providing the service must be properly marked.
The estimated receipt of waste from the mobile collection point for municipal waste (MPZOK) is specified
in the description of the subject of the contract, Annex 8 to the ToR.
