Description

1. Subject of contract:
Maintenance of carriageways and pavements in Elbląg.
Main subject matter:
CPV: 90.62.00.00-9.
CPV nomenclature: Snow services.
Additional subject:
CPV: 90.61.00.00-6.
CPV nomenclature: Street cleaning and sweeping services
2. The subject-matter of the contract is to carry out maintenance work during the winter and summer seasons, consisting, inter alia, of snow snow and combating winter slips, cleaning and cleaning the carriageways and pavements of road lanes of the streets in Elbląg.
3. The Contractor’s main duties shall include:
1. The contractor must organise the work in such a way as not to cause nuisance and danger to third parties, including road users.
2. The Contractor shall provide the scope of the contracted services with its own resources or with its own resources and subcontractors.
3. The contractor is required to conclude contracts with subcontractors, in accordance with Article 647¹ of the Civil Code.
4. The contractor must conclude contracts for the assignment of claims to subcontractors for the services rendered.
5. Copies of the contracts referred to in point III. 3.4. The ToR will be sent to the Contracting Authority within 10 days of the signature of the contract.
6. Detailed responsibilities of the Contractor concerning:
(a) winter maintenance of carriageways and pavements as referred to in Section 1. Point 3.1. of the model contract constituting Annex 3 to the ToR is included in paragraph II. “Technical conditions for the performance of the winter maintenance service” set out in Annex 1 to the model contract constituting Annex 3 to the ToR;
(b) the summer maintenance of the carriageways and pavements referred to in §1. Point 3.2. of the model contract constituting Annex 3 to the ToR is included in paragraph II. “Technical conditions for the performance of the summer maintenance service” set out in Annex 2 to the model contract constituting Annex 3 to the ToR;
(C) ‘independent services’ as referred to in Section 1, paragraph 1. Point 3.3. of the model contract constituting Annex 3 to the ToR is included in paragraph II. The ‘technical conditions for the performance of “independent services”’ contained in Annex 3 to the model contract constituting Annex 3 to the ToR.
7. The contracting authority obliges the Contractor to carry out on its behalf the acceptance of the road lane area after the completion of rescue operations, i.e. the correct clean-up of the land following an accident or a road collision in accordance with Section 31 of the Regulation of the Minister for the Interior and Administration of 29 December 1999 laying down detailed rules for the organisation of the national rescue and firefighting system (Journal of Laws 1999, No 111, item 1311) and, to that extent, authorises it to carry out those activities.
8. The contractor shall self-identify the places where the provision of the services referred to in paragraph 1 shall be carried out. The model contract constituting Annex 3 to the ToR is hindered by parking vehicles. The Contractor must agree with the Contracting Authority and the Police and make it available to the public.
9. The Contractor shall be liable vis-à-vis third parties for accidents and damage resulting from non-performance or incompetence of his obligations under this contract.
10. The service must be performed in accordance with the terms of the ToR and the ‘Technical conditions for the performance of the winter maintenance service’ set out in Annex 1 to the model contract constituting Annex 3 to the ToR, ‘Technical conditions for the performance of the summer maintenance service’ set out in Annex 2 to the model contract constituting Annex 3 to the ToR and ‘Technical conditions for the performance of ‘independent services’ in Annex 3 to the model contract constituting Annex 3 to the ToR, in accordance with the applicable laws, regulations, standards and regulations on the use of chemical and earsal agents, while complying with all safety standards and health and safety regulations.
11. Waste resulting from the cleaning of carriageways and pavements (sand, papers, leaves, etc.) must be managed in accordance with the legislation in force. The place for snow storage shall be designated by the Contracting Authority before the beginning of each winter season.
12. The contractor must hold or obtain, prior to the performance of the service, separate collection permits for municipal waste in the city of Elbląg issued by the Mayor of Elbląg.
13. The contractor must have at its disposal technical tools and facilities for the winter season and ensure that technical tools and equipment are ready by 15 October before each winter season, with a minimum number of:
a. A sandcarole-salk with plough – at least 9,
b. Snow plough vehicle – min. 4 pcs,
C. ploughing vehicle – at least 4 pcs,
D. self-discharging car – at least 2 units,
e. charger – at least 2 units,
F. Tractor – at least 3 units,
g. mini-tractor – at least 1 unit,
H. Microtractor – at least 3 units,
I. mini-charger – at least 2 units,
I. Broddway façade sweeper – min. 1 pc,
K. street sweeper – at least 2 units,
14. The contractor must have at its disposal the technical tools and facilities for the summer season with a minimum number of:
a. street sweeper – at least 2 units,
b. Broddway façade sweeper – at least 1 unit,
C. Duty charger – at least 2 units,
D. street pouch – at least 1 pc,
e. Light-type cleaning vehicle – min. 2 units
The Contractor’s pavement cleaning service will be performed manually or manually and by means of light-duty vehicles (with an actual total mass of up to 2 t). When submitting a tender, the contractor shall submit a declaration on the choice of how to perform the summer maintenance service, i.e. whether it will perform it manually and using its equipment or only manually. This statement is included in item 5. ‘Tools and technical devices required for the summer maintenance of carriageways and pavements’ in Annex 5 to the ToR ‘List of technical tools and equipment’.
15. The contractor must hold, for the duration of the services covered by this call for tenders, a civil liability insurance policy.
This will be required from the Contractor with whom a contract will be concluded.
16. During the periods during which the service is provided, the contractor must provide at least one field base, workshop facilities and an information/dispatch centre at such a distance from the city centre (Plac Słowiański) so that, at the time of a sudden weather breakdown, i.e. heavy snowfall, snowfall, etc., he can undertake the winter operation on the roads within a maximum of 20 minutes after the occurrence of the weather.
A declaration of the above, together with the location of the site, the workshop facilities and the information and dispatch point, will be required from the Contractor with whom a contract will be concluded.
4. The contracting authority does not stipulate in the ToR that part or all of the contract may not be subcontracted. The contracting authority shall require the Contractor to indicate in its tender the share of the contract which it will subcontract.
5. Information on anticipated changes to the terms of the contract in relation to the content of the tender, on the basis of which the Contracting Authority will select the Contractor:
The contracting authority shall provide for the modification of the terms of the contract concluded in the case of:
1. Amendments to the VAT percentage rules;
2. a case of force majeure making it impossible to fulfil all or part of the scope of the contract in accordance with its provisions;
3. organisational changes to the contracting authority’s or the Contractor’s internal structures.
6. The contracting authority states that it does not envisage the award of complementary contracts.
7. The contracting authority states that it does not provide for advance payments for the performance of the contract.
