This negotiated procedure without prior publication of a contract notice, concerning: ‘Provision of consultancy services under Article 166(1) of the Spatial Development Act – assessment of the compliance of investment projects and construction supervision for the site ‘Construction of incoming infrastructure (External connections) for a composting plant for biodegradable waste for the purposes of the Shumen Waste Management System, which serves the municipalities of Shumen and Novi Pazar’, comprises two lots: ​​​​​​​ The subject of lot № 1 includes the following activities for the site: - Exercising construction supervision during construction until acceptance and commissioning of the construction works within the mandatory scope regulated by the Spatial Development Act and the secondary legislation on its implementation, including carrying out inspection and control of the construction products delivered and incorporated into the construction works, ensuring the implementation of the basic requirements for the construction works in accordance with the requirements of the ordinance under Article 9, paragraph 2, item 5 of the Technical Requirements for Products Act, as well as coordination of the construction process until the commissioning of the construction works, including control of the quantities, quality and conformity of the construction and installation works performed with the contract for the execution of the engineering works on the site, as well as the other activities covered by the engineering contract; - Performing the functions of a Coordinator for safety and health in accordance with the provisions of Ordinance № 2 of 2004 on the minimum requirements for health and safety at work in the performance of construction and installation works, including the fulfillment of all obligations of the Contracting Authority provided for in the said Ordinance; - Preparation of a Final Construction Report pursuant to Article 168(6) of the Spatial Development Act and Ordinance № 2 of 31 July 2003 on the commissioning of construction works in the Republic of Bulgaria and minimum guarantee periods for completed construction and installation works, facilities and construction sites, and an updated Technical Passport for construction pursuant to Article 176a of the Spatial Development Act and Ordinance № 5 of 2006 on technical passports for construction works; - Management of the commissioning processes until the issuance of a Permission for use; - Liability under Article 168(7) of the Spatial Development Act until the expiry of the warranty periods for the respective types of construction and installation works. The subject of lot № 2 includes an assessment of compliance with the essential requirements for construction works in all parts of the investment project, in volume and content in accordance with the Spatial Planning Act, including an assessment of compliance and technical control of the ‘Constructive’ part in accordance with Article 142(10) of the Spatial Planning Act and the preparation of a comprehensive report on the conformity assessments carried out. The Contractor shall assist the Assignor in the procedure for coordination and approval of the investment project and issuance of a building permit.
