Description

1. The subject of the proceedings is the supply of new (unused) OHS articles for the needs of the 31st Tactical Aviation Base. 2. The quality requirements and the applicable documents referred to in Article 246(2) of the Public Procurement Act of the subject-matter of the contract are set out in Annex 1a – ‘price form’ to the FTZ and in Annex 4 to the FTZ – ‘draft contract’ to the FTZ. 3. The contracting authority allows the submission of partial tenders, the contract consists of 28 tasks: ZZLT and LƚB 1. Activity 1 – Gloves, 2. Task 2 – Cleaning, 3. Task 3 – Protective, 4. The Contracting Authority shall not limit the number of tasks in which the Contractor may submit a tender, but tenders for individual tasks shall be complete. The detailed description and scope of the subject-matter of the contract are contained in Annex No 1A to the SWZ (price form), Annex No 7 (OPZ), in which the required minimum quality parameters of the products are included. 5. Where the description of the subject-matter of the contract indicates trademarks, patents, origin, source or a specific process characterising certain products or services, this means that the Contracting Authority cannot describe the subject-matter of the contract in a sufficiently precise and intelligible manner and this is justified by the specific nature of the subject-matter of the contract. In such situations, the possible use of the above indications shall be read with the words ‘or equivalent’. In situations where the Ordering Party describes the subject of the contract by reference to standards, the technical assessments referred to in Article 101(1)(2) and (3) of the Public Procurement Act allow solutions equivalent to those described. 6. The Ordering Party requires that in the Price Forms for PACKAGES No. 1-28, the Contractor fills in columns requiring the proper name of the product offered, the manufacturer and the Symbol / marking of the product offered). The data provided are intended to enable the Customer to undisputedly identify, in the sources available to him, the product offered. The inability to identify a specific product on the basis of the information indicated may indicate non-compliance with the FTZ. The Customer recommends providing as much information as possible in order to eliminate the risk of giving parameters indicating two or more products at the same time. Failure to enter the requested information may result in the rejection of the offer in accordance with Art. 1 point 5 of the Public Procurement Act. 7. The contracting authority shall allow equivalent tenders to be submitted in respect of the contract in tasks 3, 5 and 8. By an equivalent offer, the Ordering Party means an assortment with the same or better quality parameters and standards in relation to the assortment indicated (desirable) by the Ordering Party. When submitting an equivalent tender (other substitutes than those provided in the form), the contractor must attach a product fiche or other document containing technical parameters enabling the conformity of these parameters with the parameters requested by the contracting authority to be assessed. 8. The Ordering Party requires that for the assortment: – in Task No 3, item 5-8 and Task No. 8 item. 10 and 11 – in Tasks 18 to 23, the production date was not older than 2024. 9. The Ordering Party requires that the packaging of the delivered items be original, undamaged, preventing moisture and damage to the goods.
