The subject of the contract is the performance of the service of performing the duties of multi-industry investor supervision over construction works carried out in the building of the Paderewski Music School Complex in Krosno. 2. The contractor, taking into account the scope of the works carried out, is to ensure the participation of professional supervision inspectors with appropriate powers in the number and time range necessary for the proper implementation of all supervised works. 3. Construction and installation works for which investor supervision will be carried out include the construction of a concert hall together with obtaining the necessary documents (e.g. protocols, consents, permits, arrangements) enabling the facility to be handed over for use in accordance with the applicable regulations and standards used in construction. 4. Supporting information: a) The estimated value of the works subject to investor supervision was determined at PLN 10,585,737.96 net. b) The scope of works performed by the contractor is specified in detail: construction design, executive design, technical specifications for the execution and acceptance of construction works, work schedules. 5. When acting as a supervisory inspector, the core duties shall include, in particular: a) implementation of the obligations assigned to the Investor's Supervision included in the contract for the implementation of construction works (Annex 9 to the Agreement); b) supervising the execution of works and their financing in accordance with the schedule of works; c) participation in construction councils, technical, problem and other meetings organized by all parties to the investment process, including those convened on the initiative of the Ordering Party's representative; d) storing documentation related to the implementation of the project, preparing draft correspondence related to the works carried out for the administration and control bodies; e) initiating or giving an opinion on proposals for amendments to the contract or the implementation of additional works (Art. 1 point 7 of the Public Procurement Act), including verification of the necessity of their implementation, compliance with the provisions of law, preparation of the necessary documentation. To the same extent, the Contractor shall be obliged in the event of the need to use alternative solutions and materials, or in the event of disclosure of defects in the design documentation. g) conducting technical supervision over the implementation of works in accordance with the Construction Law; h) performing coordination functions on the construction site; i) management of a team of industry supervisors j) constant consultation and professional advice for the Contracting Authority; k) timely preparation of documents necessary for settlements with the contractor of construction works, including preparation of settlement documents, reports and other documents required for the execution of works, cooperation in this respect with the Investor, the designer and the contractor of construction works; l) taking all necessary actions to protect the interests of the Investor; m) within 1 year from the final acceptance of construction works, supporting the Contracting Authority's activities aimed at fulfilling the contractor's obligations arising from guarantees and warranties by: supporting the contracting authority in the process of reporting possible deficiencies and defects, supervising the activities of the contractor of construction works aimed at removing the reported defects, participating in the acceptance of defective works, participating in two as-built inspections, after 6 months and 1 year from the end of construction works and drawing up a protocol from the review carried out. n) supervising the construction works carried out in accordance with Articles 25, 26 and 27 of the Construction Law and the rules of operation of the Supervision Inspector, i.e. in particular: - quality control of the construction works carried out, compliance of the works with the design and construction permit, applicable regulations and standards, technical and construction regulations, as well as OHS, SANEPID and fire regulations; - checking the contractor's possession of relevant documents (attacks, certificates, quality certificates, test results, etc.) concerning the materials and equipment used by the contractor; - checking the correctness of carrying out construction works; - checking and acceptance of covered or disappearing works; participation in tests and technical acceptance of installations, technical devices and chimney ducts, and preparation and participation in the acceptance of finished construction works putting them into use; - resolving doubts of a technical nature arising in the course of the works, and, if necessary, drawing the opinion of the Contracting Authority's representative, the author of the project or experts; ongoing documentation of financial settlements with the contractor, possible subcontractors and checking the calculation of valuations and invoices; - ongoing verification of contracts with possible subcontractors, - opinions, verification of documents and advice to the investor with regard to forms of employment of employees by the Contractor and subcontractors, - preparation of documentation regarding the final settlement of construction works; ongoing information to the Investor about the progress of construction works and possible difficulties in their implementation, in particular the presentation of a written report on the progress of construction works, or the presentation of an opinion in relation to a specific aspect of the construction works carried out, prepared - at the request of the representative of the Contracting Authority - to organize and perform, with the participation of the Investor, partial and final acceptance of the construction works and to provide the Investor with the completed scope of the investment; - drawing up applications for payment of contractual penalties by the contractor for late performance of the subject of the contract; - issue of OT, PT evidence within 30 days from the date of final receipt and submission of
