1. The subject of the contract is the performance of works in the field of winter maintenance of roads and pavements in the road lane in the city of Bytom divided into parts with the possibility of using options. 2. The subject of the contract is divided into lots: 1) Part 1: Division 1 - Traffic routes. 2) Part 2: Division 2 – Strict Centre, Centre, Downtown North, Downtown West. 3) Part 3: Division 3 – Miechowice, Karb, Stroszek, Sucha Góra, Stolarzowice, Górniki. 4) Part 4: Division 4 – Rozbark, Łagiewniki, Szombierki, Bobrek. 3. The complex of parts covered by the contract in each part for the basic scope and the optional scope is the fulfillment of the obligations related to maintaining cleanliness and order on the road lanes of public and internal roads within the administrative boundaries of the city of Bytom, imposed on the Employer in accordance with Art. 1 point 4), paragraph. 4 and 5 of the Act of 13 September 1996 on maintaining cleanliness and order in municipalities (Journal Journal of Laws of 2025, item 773). 4. The subject-matter of the contract and the manner in which it is to be performed in each lot shall specify: a) Detailed description of the subject-matter of the contract (hereinafter referred to as SOPZ) - Annex 1 to the SZB (b) Estimated quantities - Annex 1.1 - 1.4 to the SZB (c) Lists of sites - Annex 1.5 - 1.8 to the SZB (d) Scheme for snow clearing the surface of the Market Plate - Annex 1.9 to the SZB (e) Draft provisions of the contract - Annex 2 to the SZB. 5. The contracting authority accepts the possibility of submitting partial tenders for 4 parts of the procedure. 6. The offer can be made in 4 parts. 7. The Contracting Authority shall not limit the number of lots which it may award to a single Contractor. 8. The Ordering Party does not require the submission of an offer in the form of an electronic catalogue. 9. Prior to the initiation of the procedure, the contracting authority did not conduct preliminary market consultations. 10. The contracting authority does not provide for variant offers. 11. The contracting authority shall allow the procedure to be cancelled if the public funds which it intended to use to finance all or part of the contract have not been awarded to it. 12. Requirements for joint bidders to submit a tender: Pursuant to Article 58 of the Public Procurement Act, Contractors may apply jointly (consortia, civil law partnerships). If the Contractors jointly apply for the award of the contract, the Contractors shall appoint a representative to represent them in the procurement procedure or to represent them in the procedure and conclude the public contract (this shall not apply to a civil-law partnership if the Contractors attach to the tender the articles of association from which the power of attorney to act on behalf of the company will result, or all partners will sign the tender). To the extent not regulated by the FTZ, the provisions of the Regulation of the Minister for Development, Labour and Technology of 23 December 2020 on subjective means of proof and other documents or statements that may be requested by the Ordering Party by subcontractors (Journal of Laws 2020, item 2415) shall apply. 13. The contracting authority provides for the award of contracts consisting in the repetition of similar services referred to in Article 214(1)(7) of the Public Procurement Act. 16. The contracting authority shall carry out the procedure itself. 17. The notice does not concern a contract for social and other specific services. 18. The contracting authority does not provide for the requirements referred to in Article 94 of the Public Procurement Law. 19. The contracting authority does not provide for the means of proof in question. 20. The Contractor declares that he meets the requirements set out in Articles 28, 29, 30, 32, 33 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC, in particular: a) zapewnia, że stosuje środki techniczne i organizacyjne zapewniające bezpieczeństwo przekazanych danych osobowych, b) zapewnia, że dostęp do powierzonych danych osobowych mają jedynie osoby upoważnione, którym Wykonawca polecił przetwarzanie danych osobowych, c) zapewnia, że dostęp do pomieszczeń, w których przetwarzane są powierzone dane, mają jedynie osoby do tego upoważnione oraz, że dostęp do tych pomieszczeń jest nadzorowany, d) zapewnia, że systemy, aplikacje i sprzęt informatyczny wykorzystywany do przetwarzania powierzonych danych są zabezpieczone przed nieautoryzowanym ujawnieniem lub utratą powierzonych danych, e) zapewnia, że połączenie zdalnego dostępu do systemu informatycznego zabezpieczone jest szyfrowanym kanałem, f) zapewnia, że będzie współpracować z administratorem w celu realizacji praw osób, których dotyczą powierzone dane osobowe, wskazanych w Rozdziale III przytoczonego Rozp., g) zapewnia, że będzie niezwłocznie informować administratora o naruszenia ochrony danych osobowych, a także współpracować z administratorem w zakresie niezbędnym do wypełnienia obowiązków związanych z naruszeniem ochrony danych osobowych ciążących na administratorze na podstawie przytoczonego Rozporządzenia. The contractor declares that it maintains documentation confirming the above activities and that it will make the indicated documentation available at the request of the administrator.
