Description

Subject-matter of the contract: Supply, installation and warranty maintenance of furniture and equipment necessary for the Clinic of Surgical Diseases and Oncology at the University Hospital "Prof. Dr. Stoyan Kirkovich AD". In the technical specification – Annex 1, an integral part of this documentation, the contracting authority has specified the materials from which the furniture and the boarding must be made, as well as specific colours. The contracting authority considers it necessary that the furniture and equipment subject to this contract correspond in colour and design to the public procurement for major repair of the Clinic of Surgical Diseases and Oncology carried out in 2023. In order to carry out this repair, a design of the premises in the clinic was made, corresponding to the medical standard for the respective hospital activity. As a result of the repair, flooring in color was laid, walls and ceilings in a corresponding color were painted, and color-solid interior doors were also available. It is necessary that the furniture subject to this order corresponds in design and colour to the floorings already laid and the painting of walls and ceilings carried out in the premises of the clinic, in order to achieve an aesthetic solution to the overall appearance of the clinic and, by indicating the material from which the furniture is to be made, to achieve high quality, durability and durability of such furniture. Following a public contract carried out in 2023, the subject of which was: ‘Supply, installation, commissioning and warranty maintenance of doors and furniture required for the two hybrid operating rooms for tissue and organ transplantation of UMHAT Prof. Dr. Stoyan Kirkovich AD, by lots’, furniture made of EGGER boards was supplied and installed in the hybrid operating rooms of the hospital. During the busy operation of these already installed furniture made of these boards, their high quality and durability was established. In the light of the objective circumstances set out above, which make it necessary to indicate specific materials and colours, the contracting authority considers that the requirements thus laid down in the technical specification do not lead to an unjustified restriction of competition and/or an unjustified advantage for tenderers. In the version of the provision of Article 48(2) of the PPA to be considered added "or equivalent" anywhere in the documentation for participation and its annexes, which contains a reference to a register, a document for the right to perform a specific activity or a legal basis for carrying out a specific activity, depending on the legislation of the country in which the foreign participant is established. If anywhere in the documentation and technical specification there is a reference to: a specific model, source, process, trade mark, type, patent, origin, standard or production, etc., the contracting authority on the basis of Article 50(1) of the Public Procurement Act will accept any tender which the tenderer proves by any relevant document that its proposed solution meets the requirements in an equivalent manner. The contract shall not be divided into lots. Reasons: The subject matter cannot be divided into lots, given the specificity of the contract. The public contract is inherently indivisible, as its subject matter falls within the same group of supplies according to the Common Vocabulary of Vocabulary (CPV) and does not include heterogeneous supplies, therefore, in view of the main objective of the PPA to achieve efficiency in the spending of public funds, it is not appropriate to divide it into lots, as an optimal result for the performance of the supply, including a low price, is sought. Timeframe: The deadline for the execution of the delivery and installation activities is up to 30 days from the later of the two dates - the date of signing the contract and the date of receipt by the contractor of a contract letter for the execution of the activities under the order. A participant who proposes a period for performance of the contract longer than the maximum period set will be excluded from participation in the procedure. Place of performance of the contract: The place of performance of the public contract is the town of Stara Zagora, ‘UMBAL Prof. Dr. Stoyan Kirkovich AD’, with administrative address in the town of Stara Zagora, 2 General Stoletov Str. Estimated contract value: The total estimated value of the public procurement is BGN 72 442.60 excluding VAT. This value is also the limit value specified by the contracting authority. The tenderers must prepare their price proposals in accordance with the maximum estimated value of the public procurement referred to above and may not exceed it. It is consistent with the financial resources of the contracting authority. The price offer should include all costs for the execution of the contract. A tenderer shall be excluded from participation in the contract if it submits a price offer which exceeds the estimated limit for the performance of the contract. Pursuant to Article 116(1)(1) of the Public Procurement Act, the contracting authority provides for the possibility of additional delivery of the materials, furniture or separate modules thereof and equipment specified in the technical specification, in which case the value of the order may be increased to 5%. The total estimated value of the public procurement contract with the option under Article 116(1)(1) of the Public Procurement Act is BGN 76 064.73 excluding VAT. Guarantees: The guarantee for performance of the contract amounts to 7% (seven percent) of the contract value excluding VAT. The warranty period of each of the offered furniture: The warranty period offered may not be less than 84 months. Text automatically translated in your browsing language Automatically translated
