Procurement of ‘Digital Infrastructure Modernisation Equipment – Data Center – (A1) as part of the project entitled ‘Digitalisation for the future of education and research at the ‘Dunărea de Jos’ University in Galați, code 2033414941’, as specified in the tender specifications. The signature of the contract is possible only if the provisions relating to the commitment of expenditure from budgets covered by public finance legislation are complied with, and in compliance with the provisions of Decision No 395/2016 approving the implementing rules for the award of the public procurement contract/framework agreement of Law No 98/2016 on public procurement, as amended. If, for whatever reason, the acquisition of funding under the Digitalisation project for the future of education and research at the Dunărea de Jos University in Galați’ code 2033414941 is not carried out, the contracting authority shall apply the provisions of the second sentence of Article 212 (1) (c) of Law No 98/2016, as amended, and it is impossible to conclude the public procurement contract. Tenderers in this procedure state that the Contracting Authority and/or ME cannot be held liable for any damage in the event of annulment of the award procedure, regardless of its nature and regardless of whether the Contracting Authority and/or the IMP have been notified of the existence of such damage.
