1. The subject of the contract is the purchase of rights to use Oracle Paas & IaaS Universal Credit or an equivalent service for the maintenance of IT systems supporting the implementation of operational programmes co-financed by the EU. The description of the subject of the Order (OPZ) is contained in Annex 1 to the FTZ. After the conclusion of the contract (the draft provisions of the public procurement contract constitute Annex 2 to the FTZ), it will constitute an annex to the contract. 2. The contracting authority does not provide for the possibility of awarding the contract referred to in Art. 1 points 7 and 8 of the Act. 3. The contracting authority provides for the possibility of exercising the right of option consisting in: purchase of an increase in the number of Universal Credits provided as part of the service indicated in § 2 sec. 1 point 1 PPU, for a period of 12 months from the date of launching the increase or purchase of expert consultancy producer services for the service indicated in § 2 sec. 1 point 1 of the PPU, for a period of 12 months from the date of launching the service, up to a maximum of 500 man-hours. Details of the option right are described in the PPU and OPZ. 4. The Contracting Authority does not envisage that the Contractor will carry out an on-site visit. 5. The Contractor is obliged to lodge a security in the amount of PLN 30,000.00 (in words: thirty thousand 00/100). A security may be lodged at the choice of the contractor in one or more of the following forms: 1) money; 2) bank guarantees; 3) insurance guarantees; 4) guarantees provided by entities referred to in Art. 5 point 2 of the Act of 9 November 2000 on the establishment of the Polish Agency for Enterprise Development (Journal of Laws No. Journal of Laws 2024, item 419). Before signing the contract, the contractor must lodge a performance bond of 3% of the total gross price indicated in the tender for the performance of the contract. A security may be lodged, at the choice of the contractor, in one or more of the following forms: 1) money; 2) bank guarantees or guarantees of a cooperative savings and credit union, except that the obligation of the credit union is always a monetary obligation; 3) bank guarantees; 4) insurance guarantees; 5) warranties given by entities referred to in Art. 5 point 2 of the Act of 9 November 2000 on the establishment of the Polish Agency for Enterprise Development. The Contracting Authority reserves that it may first examine and evaluate the tenders and then make a qualitative selection of the Contractor. 8. The procedure for the award of a public contract is conducted in an open tender procedure pursuant to Article 132 of the Public Procurement Law Act of 11 September 2019 (Journal of Laws Journal of Laws 2024, item 1320 as amended) and implementing acts issued on the basis thereof. 9. The order will be executed on the following dates: 1) purchase of rights to use Oracle Paas & IaaS Universal Credit or an equivalent service, for a period of 12 months from the date of launching the service; 2) purchase of an increase (option right) in the number of Universal Credits provided as part of the service indicated in point 1, for a period of 12 months from the date of launching the increase; 3) purchase of expert consultancy services (option right) for the service indicated in point 1, for a period of 12 months from the date of launching the service; 4) purchase of rights to use the Oracle System Support Center service as an Intelligent Ops Service ("PaaS") and ("IaaS") (Oracle Solution Support Center for Standard SSC, Intelligent Ops, and PaaS/IaaS) for the service indicated in points 1 and 2, for a period of 12 months from the date of launching the service.
