Description

Task No 1.
Granting of a bank loan of up to PLN 50000000 to repay liabilities arising from borrowings and securities issued.
(a) The Contractor shall grant the Contracting Authority a loan in Polish currency of up to PLN 50000000 under the conditions laid down in the loan agreement.
(b) The contracting authority shall dedicate funds from the loan to repay liabilities arising from borrowings and securities issued, in accordance with Article 89. 1 point 3 of the Public Finance Act of 27 August 2009 (Journal Of Laws 2009, No 157, item 1240).
(C) The loan will be granted for the period from the date of conclusion of the agreement to 10 October 2022.
Task No 2.

(a) The Contractor shall grant the Contracting Authority a loan in Polish currency of up to PLN 66707115 under the conditions laid down in the loan agreement.
(b) The contracting authority shall dedicate funds from the loan to repay liabilities arising from borrowings and securities issued, in accordance with Article 89. 1 point 3 of the Public Finance Act of 27 August 2009 (Journal Of Laws 2009, No 157, item 1240).
(C) The loan will be granted for the period from the date of conclusion of the agreement to 10 October 2022.
3. The detailed description of the subject-matter of the contract is set out in Annexes 4.1 and 4.2 to the ToR.
4. The detailed conditions for performance of the contract are set out in the draft contract constituting Annexes 5.1 and 5.2 to the ToR.
5. The Contracting Authority requires the Contractor to attach to the tender the Terms and Conditions (if any) applicable to the Contractor for the service in question in order to verify their conformity with the draft contract (pursuant to Article 384. 1 of the Civil Code).
6. If the provisions of the draft credit agreement conflict with the Contractor’s Rules of Procedure, the Contractor shall attach to the tender a declaration stating that the provisions of the Terms and Conditions which are contrary to the provisions of the credit agreement will not apply to the Contracting Authority.
