Description

1. The subject-matter of the contract is the purchase of new SUVs of the “marked” version of the police, together with the service of periodic warranty inspections.
2. As a basic purchase, the Contracting Authority will purchase 107 vehicles with:
— Task 1: the supply of 96 SUVs in the police version “marked” with 4x4 drive, together with the provision of warranty inspection services,
—Task 2: the supply of 11 SUVs in the police version “marked” together with the provision of warranty inspection services.
In addition, under the option option, the Contracting Authority plans to purchase additional vehicles:
(a) as regards task No 1 to 15 units of vehicles;
(b) in the scope of Task No 2 to 5 units of vehicles.
The prices of vehicles and warranty services purchased under the option right will be identical to the prices of vehicles and warranty services purchased in the base contract.

4. All vehicles delivered (within the different tasks) will be the same brand, model and equipment version.
5. A detailed description of the subject matter of the contract is set out in Annexes 1A and 1B.
6.In connection with the subject matter of the contract, the Contractor shall:
(a) the supply of vehicles and equipment as defined in Annexes 1A and 1B;
(b) agree with the Contracting Authority on an ongoing basis on how and where the equipment is to be installed on the vehicle, and in particular:
the installation of power supply for radio communication equipment,
— equipment for measuring fuel consumption,
— aerial installations,
other specialised service equipment (e.g. mobile terminal);
(C) the provision of consultations on vehicle repairs, including technical advice related to the operation and repair of vehicles.
7. The procurer shall require that the vehicles supplied:
(a) were factory new;
(b) originated in the current year of production for delivery;
(C) are fully operational;
(D) are free from defects preventing their intended use;
(e) have a zero inspection carried out by the Contractor, certified in the vehicle’s guarantee book;
8. The contracting authority shall require that the vehicles supplied be constructed in accordance with:
(a) the technical specifications referred to in Annex 1A, 1B;
(b) principles of technical knowledge, generally applicable standards and standards, taking into account applicable legislation.
9. On the day of delivery of the vehicles, the contractor will provide the Contracting Authority with complete documentation for each vehicle, drawn up in Polish, containing inter alia:
(a) a guarantee book;
(b) the instructions for use of the base vehicle and its building elements and equipment, which must include (in the form of descriptions, diagrams, drawings and photographs) issues relating, inter alia, to:
— the operation and servicing of the vehicle and its installation and equipment,
— places where communication equipment is installed, with the routes and method of aerial, supply, signal and control ducts, as well as the location and means of connection of the power supply,
— safe use and operation of the vehicle,
(C) the vehicle card;
(D) a service survey book;
(e) an extract from the approval certificate or the EC certificate of conformity for the base vehicle and a declaration by the manufacturer/importer confirming the vehicle data not included in the certificate but necessary for the registration of the vehicle;
(F) a document confirming the first technical inspection of the privileged vehicle prior to the first registration, in accordance with the provisions of the Road Traffic Act (i.e.: Journal of Laws 2012, item 1137 as amended);
(g) a list of equipment;
(H) a catalogue of replacement parts of the vehicle on an electronic medium.
10. The Contractor will be required to provide guarantees for the vehicles delivered, without a limit of kilometres, as appropriate:
1) for the mechanical, electrical and electronic components of the vehicle – at least 24 months;
2) for paint coating – at least 36 months (without cut-offs);
3) for the perforation of bodywork elements – at least 72 months;
4) to signal the privilege in motion, on sound and light-signalling devices – at least 24 months;
(5) for the total marking of the vehicle – at least 36 months
— calculated from the date on which the Parties sign the acceptance report of the vehicle(s) without comments.
If the manufacturer’s guarantee is less than the minimum required by the Contracting Authority, the guarantee given by the Contractor shall be binding on the parties.
11. During the period covered by the guarantee referred to in point 10(1), the contractor will be required to carry out warranty tests on the vehicles purchased under this procedure. The contracting authority shall require that warranty reviews be carried out:
— for Task 1: at service stations located at a distance: up to 20 km from cities: Radom, Olsztyn, Gorzów Wielkopolski, Bydgoszcz, Łódź, Kraków, Warsaw, Rzeszów, Gdańsk, Opole, Lublin, Poznań, Kielce, Katowice, Białystok, Wrocław,
— for Task 2: at service stations located at a distance: up to 20 km from cities: Radom, Płock equipped to perform technical inspections of the base vehicle brand;
12. The contracting authority shall require that vehicles supplied as part of the implementation of the contract comply with the standards specified in the Regulation of the Prime Minister of 10 May 2011 for energy consumption, carbon dioxide emissions and pollutant emissions: oxides of nitrogen, particulate matter and hydrocarbons.
13. During the vehicle modification phase, the contracting authority will compare the conformity of the modifications made by the Contractor with the requirements set out in the Vehicle Technical Specifications. At this stage of the performance of the contract, the contractor must provide the documents referred to in Annexes 1A and 1B.
14. The delivery/reception of the vehicles will take place in Radom at the premises of KWP in Radom ul. 11 Listopada 37/59.
