Description

2.1.Due to a lack of knowledge about the exact composition and characteristics of waste in all containers and receptacles, as well as in bulk, waste should be treated as waste with codes from the groups of: 07 Wastes from the production, preparation, marketing and use of products of the organic chemistry industry 08 Wastes from the production, preparation, marketing and use of protective coatings (paints, varnishes, ceramic enamels), putty, adhesives, sealants and printing inks 12 Wastes from shaping and physical and mechanical surface treatment of metals and plastics 14 Wastes from organic solvents, coolants and propellants (excluding groups 07 and 08) 15 Packaging wastes; sorbents, wiping cloths, filter materials and protective clothing not included in other groups 16 Waste not included in other groups 19 Waste from waste management installations and equipment, from waste water treatment plants and from the treatment of drinking water and water for industrial purposes. The visual composition and properties of the waste were defined in the expert opinion entitled: ‘Qualitative and quantitative inventory of waste collected at 39 Nowowiejska Street, located on plot 28/1, 29/1, 29/2 area 02 Pińczów city, Pińczów municipality’, made for April 2025 at the request of the Pińczowski District, which is Annex 9 to the OPZ. After the conclusion of the contract, the Contractor becomes the Manufacturer of the seized waste and it is the Contractor of the service who precisely determines the waste codes. 2.2 Subject matter and scope of the contract: 2.2.1 The subject of the contract is ‘Disposal and management of waste located at ul. Nowowiejska 39 in Pińczów on plots no. 28/1, 29/1, 29/2, Pińczów commune, Pińczów district, Świętokrzyskie voivodeship’ (hereinafter referred to as waste), placed in various types of containers (including mausers, barrels of various capacities, compacted, bulk, etc., on plots Nos 28/1, 29/1, 29/2 of 02 of the city of Pińczów and subjecting them to final recovery or disposal processes appropriate to the characteristics of the waste. Location of the property and its designation in the form of a map constituting Annex 1 to the OPZ. 2.2.2 Estimated amount of waste referred to in point 1.1. OPZ, that's okay. 1389 Mg. The performance of the contract includes the removal and subjecting to final recovery or disposal of all waste referred to in point. 1.1. OPZ. Illustrative photographs showing the deposited waste and the place where it was collected constitute Annex No 2 to the OPZ. 2.2.3 The implementation of the above task takes place on the basis of the decision of the Local Government Appeals Board in Kielce ref. SKO.OŚ-60/5337/256/2024 of 13 January 2024 issued pursuant to Art. 1, in the mouth. 2 point 2, par. 3 - 5 of the Act of 14 December 2012 on waste, in connection with the administrative enforcement of the decision of the Mayor of Pińczów, ref.: RLiO.VII.6233.7.2017, withdrawing without compensation the permit to collect waste in Pińczów, area 2, Pińczów Municipality, at 39 Nowowiejska Street, in view of the need to take measures consisting in the removal and management of the waste in question due to the risk they pose to human health and life and the environment. The abovementioned decisions are Annexes 3 and 4 to the OIP. 2.2.4 The performance of the subject of the contract should take into account the requirements of the Act of 11 January 2018 on electro-mobility and alternative fuels. 2.2.5 A detailed description of the subject and scope of the contract is set out in Appendix 1 to the FTZ. 2.3 Additional requirements for the performance of the contract – Article 95 of the Public Procurement Act: 2.3.1 In accordance with Art. 1 of the Public Procurement Act, the Contracting Authority requires the Contractor (or Subcontractor within the meaning of Article 7(27) of the Public Procurement Act) to be employed on the basis of an employment relationship, persons performing activities within the scope of the subject of the contract, i.e.: a. preparation for transport, weighing of waste – at the place where the waste is loaded, b. loading and transport of waste, c. recovery or disposal of waste, d. structuring of the site, e. documenting the work carried out in relation to the implementation of the subject of the contract 2.3.2 The Contractor shall, at the request of the Contracting Authority, document the fact of employment, by submitting by the Contractor, in particular: a. a certified copy of the employment contracts of the above-mentioned persons confirming: the name of the employee, the type of activities performed, the period of employment, the employer (other personal data concerning the employee should be blacked out in a way that ensures their anonymisation) , b. statements of the employee, c. statements of the Contractor or Subcontractor on the employment of an employee under an employment contract, or other documents containing the above-mentioned information confirming the employment of the above-mentioned persons. The Contracting Authority may at any time request additional documents or clarifications if it finds that the documents submitted by the Contractor give rise to doubts as to their authenticity or as to the circumstances which they should confirm. In such a case, the Contractor is obliged to submit additional documents within the time limit set by the Contracting Authority. 2.3.3 In the event of non-compliance by the Contractor with the requirement to employ on the basis of an employment contract persons performing the above-mentioned activities, the Contracting Authority shall provide for a penalty in the form of an obligation on the Contractor to pay a contractual penalty in the amount specified in the draft provisions of the contract constituting Annex 2 to the FTZ. Failure by the Contractor to submit the evidence requested by the Ordering Party within the time limit set by the Ordering Party in order to confirm compliance with the employment requirement under the employment contract shall be treated as failure to comply with the employment requirement under the employment contract of persons performing the indicated activities. 2.3.4 In the event of reasonable doubts as to the Contractor's compliance with labour law, the Contracting Authority may request an inspection by the National Labour Inspectorate. 2.3.5 Permissions Orders Text automatically translated in your browsing language Automatically translated
