The subject of the contract is the execution of construction works consisting in the modernization of the dormitory building No. 5 and the transfer of the server room to building No. 7 located on the premises of the Police Training Center in Legionowo in the "design and build" formula. 2. The full scope of works was included in the Functional and Utility Programme, constituting Annex No. 1 to the SWZ. 3. If it is necessary to submit a notification or other activities prior to the commencement of construction works referred to in the Construction Act of 7 July 1994 (Journal of Laws No. Journal of Laws 2024, item 725), the Contractor will perform them under this contract. 4. The design should take into account the technical and functional parameters of the adopted material solutions and selected technologies. 5. The Ordering Party reserves the right to modify the adopted design solutions. 6. The deadline for completing the complete design documentation along with obtaining the necessary opinions, arrangements and, if necessary, submitting a notification or other activities preceding the start of construction works within 205 days from the date of signing the contract. 7. Execution of complete project documentation may not exceed the amount of PLN 1,800,000.00 (in words: one million eight hundred thousand zlotys). 8. At the stage of preparing the design documentation, the Contractor is obliged to present the concept of the functional layout of the building and the living room in order to obtain the Contracting Authority's approval. 9. The Contracting Authority requires the employment of at least six persons on the basis of an employment relationship in accordance with Article 95 of the Act, who will perform the following activities during the performance of the contract, according to Annex 7 to the SWZ: - construction works; - electrical and teletechnical works; - sanitation works. 20. During the execution of construction works covered by this contract, the Ordering Party is entitled to perform control activities against the Contractor regarding the Contractor's compliance with the requirement of employment under the employment contract of persons performing the activities indicated in the above point. The Ordering Party is entitled in particular to: a) request statements and documents confirming compliance with the above-mentioned requirements and assessing them, b) request clarifications in the event of doubts regarding the confirmation of compliance with the above-mentioned requirements, c) carry out on-the-spot checks on the performance of the service. 21. Failure by the Contractor to submit within the time limit set by the Contracting Authority the evidence requested by the Contracting Authority in order to confirm that the Contractor meets the requirement of employment under the employment contract shall be treated as failure by the Contractor to meet the requirement of employment under the employment contract of persons performing the activities indicated in the above point. 22. In the event of justified doubts as to compliance with labour law by the Contractor, the Contracting Authority may request an inspection by the National Labour Inspectorate. 23. Pursuant to Article 257 of the Act, the Contracting Authority may cancel the procurement procedure if the public funds that the Contracting Authority intended to use to finance all or part of the contract have not been awarded to it. 24. The Ordering Party reserves that the total value of the contract may not exceed the funds available for this purpose. 25. With reference to Article 455 para. 1 of the Act, the parties have the right to change the content of the contract.
