Description

1. The subject of the contract is the execution of construction works related to the completion of the construction of the concert hall and chamber hall in the building of the Mieczysław Karłowicz Music School Complex in Zielona Góra - ul. The Wild 6. 2. A detailed description of the material scope and the requirements are described in the design documentation, the technical specifications for the execution and acceptance of the works and the work dimensions (supplement/complement to Annex 7 to swz). However, it should be noted that the attached pre-measures are only an auxiliary element in determining the offer price. The quantities contained in them are not binding, the required scope of works has been defined in the design documentation. Under the terms of the model contract, the Contractor is required to perform the subject-matter of the contract in accordance with the design documentation, the principles of technical knowledge, the applicable regulations and the technical specifications for the execution and acceptance of the works – as part of a flat-rate price. 3. The Contracting Authority requires the Contractors to carry out (at their own expense, within the deadlines agreed with the director of the facility) a local inspection. 4. The proceedings in question are part of a project implemented by the Contracting Authority - Centre for Artistic Education in Warsaw entitled "Expansion, reconstruction and renovation of concert halls of art schools in Poland" - a project co-financed by the EU under the European Funds for Infrastructure, Climate and Environment Programme 2021-2027. 5. The financial terms of the settlements have been included in the model contract. 6. In view of the requirements laid down in Article 95 of the Public Procurement Act, the Contracting Authority shall require, in respect of the posts described in Annex No 7 to the Contract, a declaration (in accordance with the model set out in Annex No 9 to the Contract) that the Contractor and any subcontractors employ persons in those posts on the basis of an employment contract. The Ordering Party may, to the extent permitted by the applicable regulations, check the accuracy of the submitted statement. For this purpose, it may request from the Contractor and subcontractors information and documents certifying the employment of designated persons under an employment contract. Detailed information on how to verify is included in the agreement. 7. Warranty. a) The warranty period for completed construction works and installed equipment and materials is a minimum of 60 months. The minimum warranty period for completed construction works and installed equipment and materials is 60 months counted from the date of signing the final protocol. The extension of the warranty period by the Contractor (max. 90 months) is one of the elements of the tender evaluation criteria, and the Contracting Authority informs that the scoring method for the warranty period proposed by the Contractor is specified later in the tender specifications. (b) When granting the guarantee, the Contractor provides free warranty review activities during the warranty period for the entire subject of the contract covered by it, so he should include these costs in the remuneration. Inspections will take place at least once a year, unless the manufacturer's warranty of a given material requires more frequent warranty inspections.
