The component ‘Waste collection containers’, part of the Integrated Waste Management System in Sibiu County, aims to continue the local strategy for the development of the integrated waste management system in Sibiu County in accordance with the provisions of the Sibiu County Waste Management Plan 2019-2025, thus contributing to the sustainability of the integrated management system in order to comply with the provisions of the directives applicable to the waste management sector (Directive 99/31/EC on the landfill of waste and the Waste Framework Directive (2008/98/EC). The objective of Sibiu County Council is to improve the waste management infrastructure and implicitly the quality of the environment in Sibiu County by extending the separate collection within SMID Sibiu in order to meet the objectives related to increasing the share of recycled / recovered waste in the total amount of waste collected and reducing the amount of waste landfilled. On 16 February 2023, for the component ‘Waste collection containers’, the Financing Application – code SMIS 158170 – was uploaded to the MySMIS platform to access funding from the Large Infrastructure Operational Programme 2014_2020. The procedure for awarding the public contract is initiated under the standstill clause, in the sense that the conclusion of the public contract is subject to the allocation of budget appropriations for this purpose, the signing of the contract for the supply of collection containers being made in compliance with the provisions relating to the commitment of expenditure from budgets falling under the legislation on public finances. If, for any reason, the budgetary commitments/credits are not allocated, for a period of 6 months from the date of the conclusion of the Report of the procedure and of the final settlement of any appeals, the award procedure will be automatically cancelled, provided that there is no other source of funding, in accordance with the provisions of Article 212(1)(c), sentence 2 of Law 98/2016, as subsequently amended and supplemented, making it impossible to conclude the public procurement contract. Tenderers in this procedure accept the use of the above special conditions/standstill clause, assuming full liability for any damage they may suffer in the situation described. The maximum period for which the standstill clause operates is 6 months, so that if the condition of signing the financing contract is not met, the award procedure is cancelled. Tenderers in the procedure assume by submitting their offer the obligation to extend the validity of their offer, at the simple request of Aut Account, if Aut Account will be in the situation of applying the suspensive clause. The CA will respond clearly and completely to all requests for clarification/additional information by economic operators at least 12 days before the deadline for submission of tenders. The Aut cont will only respond to requests for clarifications from economic operators by the deadline set in Sec. I.3, i.e. 20 days before the deadline for submission of tenders.
