The scope of the contract is as follows: - delivery of the subject of the contract to the contracting authority's premises - installation and commissioning of the delivered equipment/equipment, - training of the contracting authority's staff in the field of operation, cleaning, disinfection/sterilization and maintenance of the delivered subject of the contract, - provision of the required documents (in accordance with the provisions of the contract). A detailed description of the subject-matter of the contract - is indicated in Annex No. 2 - Technical parameters The Ordering Party requests that the delivered subject-matter of the contract meet the requirements set out in the Act of 7 April 2022 on medical devices (Journal of Laws of 2022, No. Journal of Laws 2024, item 1620, as amended), complied with the requirements set out in other specific provisions and standards applicable to the subject-matter of the contract and with the minimum requirements set out in the FTZ. The contractor must have the documents confirming the above and is obliged to provide them to the contracting authority at any request and at any time. The Ordering Party demands that the subject of the order be new, free from physical and legal defects and pre-packaged, manufactured not earlier than 2025. The contracting authority shall allow equivalent solutions. An equivalent solution should be understood as the use of a parameter other than the one described, while maintaining the technical, quality, utility and functional parameters referred to in the FTZ. The device offered with equivalent parameters must be allowed to be used in accordance with the applicable law. The Ordering Party reserves that the proposed equivalent solution may not have quality characteristics inferior to the parameters required by the Ordering Party in the Terms and Conditions of the Order. The Ordering Party reserves that if the Contractor proposes a subject of the contract other than that specified by the Ordering Party (equivalent), it is obliged (for comparative purposes) to submit to the Ordering Party appropriate documentation, which will include, in particular, the parameters of the proposed subject of the contract. Provision is made for the possibility of cancelling the procurement procedure if the funds which the contracting authority intended to use to finance all or part of the contract are not awarded.
