Description

The public procurement procedure resumed with a view to implementing the project financed from the NRRP, component 7-Digital transformation, investment I3, investment specific to I3.3-investments in information systems and digital infrastructure of public health units entitled ‘Digitalisation of the Emergency Military Hospital “Dr. Alexandru Augustin “Sibiu”, financing contract No 1691/281/I3.3/12.09.2024, in accordance with the attached tender specifications. Number of days until which clarifications can be requested before the deadline for submission of tenders/candidates - 18. The contracting authority will respond fully to all requests for clarifications on the 11th day before the closing date for submission of tenders, Suspensive clause: The award of the public contract is initiated under this standstill clause, in the sense that the conclusion of the public contract is subject to the allocation of funds in the unit’s budget under financing contract No 1691/281/I3.3/12.09.2024. Having regard to the provisions of Law No 98/2016 on public procurement and Government Decision No 395/2016, as amended, the contracting authority states that it will conclude the contract with the successful tenderer only to the extent that the funds necessary for the procurement will be allocated to the unit’s budget. If, for whatever reason, the funds are not approved, the award procedure will be automatically cancelled, in accordance with the second sentence of Article 212(1)(c) of Law No 98/2016, as amended, making it impossible to conclude the public procurement contract. The tenderers in this procedure understand that the contracting authority cannot be held liable for any damage in the event of cancellation of the award procedure, regardless of its nature and regardless of whether the contracting authority has been notified of the existence of such damage. Tenderers in this procedure accept the use of the above special conditions/suspension clause, assuming full responsibility for any damage they may suffer in the situation described. The maximum estimated deadline for the application of the standstill clause is 31.12.2025. Having regard to the provisions of Law No 98/2016 on public procurement and Government Decision No 395/2016, as amended, the Contracting Authority states that it will conclude the contract with the successful tenderer only to the extent that the funds necessary for the procurement will be provided by allocating budget appropriations for that purpose. If, for any reason, the budget appropriations will not be allocated, the Contracting Authority, after receiving notification of the non-granting of funding, reserves the right to cancel the award procedure, provided that there is no other source of funding, in accordance with the second sentence of Article 212(1)(c) of Law 98/2016, as amended, and it is impossible to conclude the public procurement contract. The tenderers in this procedure understand that the Contracting Authority cannot be held liable for any damage in case of cancellation of the award procedure, regardless of its nature and regardless of whether the Contracting Authority has been notified of the existence of such damage. The tenderers in this procedure accept the use of the above special conditions / suspensive clause, assuming full responsibility for any damage they might suffer in the situation described, in case of cancellation of the procedure or if they do not conclude the public contract due to lack of financing.
