Description

The municipality of The Hague intends to purchase vehicles with open and closed loading units for the AM electric driving licence, and wishes the option of repair and maintenance to be carried out by the supplier of the vehicles. The contracting authority intends to enter into a framework contract with one supplier to meet this need. The municipality has a shortage of people with a B licence in some sections. Vehicles are needed that can be driven by these staff to move people and especially materials. These vehicles can be used, inter alia, for: emptying pulls in the city; green maintenance in parks and dune areas; transport equipment; The purchase of vehicles with open and closed loaders on AM driving licences addresses the insufficient employability of staff without a B licence. The contract was put out to tender in accordance with the negotiated procedure without publication. Through that procedure, the contracting authority carried out consultations with its chosen candidate and negotiated the terms of the contract. The candidate concerns Autobedrijf Houtwijk B.V. in The Hague. Following a market consultation carried out by the contracting authority, Autobedrijf Houtwijk B.V. was selected to participate in the negotiated procedure. The applicant was the only tenderer to present itself with an appropriate vehicle, Aixam Mega E-Truck 48V, which complies with the conditions set by the contracting authority in the market consultation. The contracting authority invokes the exception provided for in Article 2.32 (1) (b2) of the Aanbestedingswet 2012: the absence of competition for technical reasons. A publication of a notice of voluntary transparency in accordance with Article 4.16 of the Aw 2012 shall be published by the contracting authority. Within twenty (20) calendar days, contractors may express their opposition to the contracting authority’s intention to award the contract as a result of the tendering procedure completed. This period of 20 calendar days suspends the final award of the Contract. If, within twenty (20) calendar days, a contractor presents a (justified) objection to the award of the Contract, the contracting authority is entitled (and may be obliged) to suspend or terminate the Tender Procedure. If interlocutory proceedings have not been lodged in advance within twenty (20) calendar days from the date of dispatch of the Notice of Voluntary Transparency, the successful tenderers may no longer raise objections to the decision and have processed their rights in that regard. In that case, the contracting authority is free to comply with the award decision. In that case, other contractors also processed their rights to bring an action for damages in proceedings on the substance of the matter. If interlocutory proceedings have been brought, no award shall be made unless the urgency so requires.
